Mr. Fox never communicates. I was constantly trying to contact him and he refused to return any of my phone calls. When I attended court, Mr. Fox failed to schedule/file the proper paperwork for the counter contempt against my ex-wife. He then spent an inordinate time arguing with the magistrate and the opposing counsel about not being able to "piggy back" his arguments on the opposing counsel's motions. I have never been so thoroughly embarrassed and never expected such behavior from an attorney. Later, an additional court hearing was scheduled and Mr. Fox failed to inform me of this court date, nor did he communicate the ruling of that court date. This event occurs prior to requesting a suspect to take a breath test on an Intoxilyzer breath machine. In the past ten (10) years, this is a topic of interest to many of our viewers.  The breath analysis must be voluntary. The breath test is only voluntary, if the arresting officer properly informs suspects of their options. Recently, one court ruled that where the DUI investigator misinformed a D U I suspect that he would be eligible for hardship license, if he submitted to breath test. The officer also told him he would not be eligible if he refused the test. Based upon that misinformation, it could not be proven that DUI suspect's decision to submit to test was not influenced by misinformation. The state failed to prove that submission to test was voluntary and aMotion to Suppressthe Breath Test results was granted.
