As aTampa Family Law Attorneywith 20 years of experience in the Tampa Bay area, I have handled manydivorceandpaternitycases involvingcustody/time-sharingof children.  The courts in Florida typically award shared parental responsibility.  Shared parental responsibility does not necessarily mean equal (sole) time-share.  Rather, shared parental responsibility requires the parties to confer regarding significant decisions affecting the children’s lives.  Some significant areas of a child’s life that require the parties to confer under shared parental responsibility are education and health.The opposite of shared parental responsibility is sole parental responsibility.  The court will usually only order this type of parental responsibility when shared parental responsibility is deemed to be detrimental to the child and contrary to the child or children’s best interest.  If sole parental responsibility is ordered, the parent being appointed will have the right to make decisions concerning the child or children without input from the other parent.  It is worthy to note that sole parental responsibility is usually the exception rather than the rule. After the type of parental responsibility is established, the court will establish aParenting Planthat addresses, among other things, the time-sharing schedules between the parties.  In establishing a time-sharing schedule, the court will look to what is in the child or children’s best interests that takes into consideration the factors enumerated in€ 61.13 Florida Statutes. Once the time-sharing schedule is determined, the court will then look to establish the amount ofchild supportand in doing so, the court will base child support upon the FloridaChild Support Guidelines, which is located at€61.30, Florida Statutes. The amount of overnight time-sharing (custody) a parent has with the child typically has an impact upon the amount of child support ordered.  When a parent has overnight of time-sharing (custody) of at least twenty percent (20%) (i.e. 73 nights) a downward deviation to the child support is typically warranted.
