Should I take the breath test after a DUI Arrest in Tampa FL?

As a DUI attorney in Tampa, I often get asked this question: "If I get arrested for a DUI should I take the breath test or refuse?"  Until recently the best answer used to be "It depends." Recent changes in DUI law, however, now mean that refusing to take the breathalyzer is often the better option (at least for a first DUI).  [Disclaimer: A second refusal can result in a separate criminal offense so this article applies only to a first refusal.] Reasons to Refuse to Take the Breathalyzer Test Refusing to take the breath test after a First DUI arrest in Tampa has several important advantages. First, Florida law provides for several enhanced penalties if you blow over a .15 including:   A higher fine - if you submit to the breath test and blow over a .15 then the fine will be more - between $500 to $1,500 more compared to a DUI refusal case; and The ignition interlock device - if you submit to the breath test and blow over a .15 then the court is required to impose a condition that you install the ignition interlock device for 6 to 12 months for a first DUI conviction Second, Florida law recently eliminated the biggest deterrent to refusing. Prior to July 1, 2013, for a first DUI arrest, if you refused to take the breath test then you would receive a 90 day hard suspension.  The term "hard suspension" means that under no circumstances would you be able to drive for that 90 day period - not even to work. Now if you refuse after a first DUI arrest then you can often avoid the 90 day hard suspension by immediately requesting a hardship license.  [To apply for immediate reinstatement you must waive your right to contest the administrative suspension, show proof of enrollment in DUI school, and have no prior DUI arrest or conviction. This may not be the best option for every person - but at least the option is available.] Third, by refusing to take the breath test you are eliminating the prosecutor's most important piece of evidence - the breath alcohol reading. Prosecutors are often willing to reduce cases involving a person who refused testing over a breath test case with a reading over .08. Fourth, by refusing the individual is protected from an unreliable or inaccurate result from Florida's Intoxilyzer 8000. These machine were put into service in 2006. As the machines get older more repairs are needed and those repairs become more expensive. To compound the problem, the FDLE and local law enforcement agencies have decreased funding and cut corners. What are the Advantages of Taking the Breath Test? The most obvious advantage of taking the breath test after a DUI arrest in Tampa, FL, is that you might blow under the legal limit of .08. For most people predicting the breath test reading is nearly impossible. It depends not just on the amount of alcohol consumed, but also on the time period during which it was consumed, the weight of the driver, whether the driver is male or female, and a host of other factors.  Predicting the breath test result after a DUI arrest also assumes that the Intoxilyzer 8000 is working properly and that the results are accurate and reliable. The administrative suspension for a breath test case is less than the administrative suspension for a DUI refusal case. For instance, for a first DUI, if you refuse then your license will be administratively suspended for 12 months. On the other hand, if you take the breath test and blow over a .08 then your administrative suspension will be for only 6 months.  If you contest the administrative suspension and it is not invalidated, then you face a 90 day hard suspension instead of the 30 day hard suspension that comes with a breath test. Those difference are even more pronounce for a second refusal.   On the other hand, for a first DUI the administrative suspension makes little difference if you are ultimately convicted of DUI because of the breath test reading. This is because the court is required to impose another 6 month court ordered suspension when you enter the plea, which is usually months after the arrest. Therefore, the court ordered suspension and the administrative suspension might add up to approximately the same 12 months imposed on the person who refused chemical testing. To Blow or Not to Blow Recent changes in Florida's DUI law have swung the pendulum in favor of refusing the breath test after a first DUI arrest.
