Don't sign anything! Attended a presentation last week. Talk about high pressure sales. The guy - Marcus - was really good. Unfortunately, when we reviewed the sales contract, in addition to having many typos, the contract disagreed with a lot of the stuff that Marcus said. Hmmmm.. Oh yes, the sales guy offered to show us a three-page summary of the contract. But why review a summary if you can simply review the contract itself. Hmmmm. So, high pressure sales and lies, lies, lies. What more can anyone say. ...read more

Knockem Sockem Lawyer

Lawsuit In search of a lawyer or law firm that has the stomach to punch our illegal competitors and the city in the nose. A knock them sock em robot battle royale. A cab company quarantine in the ancient city: Saint Augustine. Esquires and knights, bishops and queens in a noble quest to vanquish greed and corruption in the business world of taxis. An advocate, a royal champion is what we at Abraxi taxi need help with. Either with the enforcement of city regulations, or the liquidation of these fiats, and financial compensation, lawyer fees and penalties under the (Florida Deceptive & Unfair Trade Practices Act). Not many taxi companies have complied with the city of Saint Augustine taxi regulations for many years. I do see their vehicles parked at the DoubleTree, the Plaza de la Constitucion the two taxi stands on the square, taken over by golf carts in downtown Saint Augustine. Vehicles have no medallions or medallions not current. These cars/busses/low speed vehicles for for hire and pedicabs just travel illegally from hotel to hotel picking up passengers and then taking them back, we think we can prove they are costing us dearly and the day will come when injuries may be more than just monetary. With the traffic conditions and alcohol fueled jaywalkers; why is the city allowing these criminal elements operating without the proper requirements. Sooner or later a debt will be due. The city should start being more proactive then reactive or just not pass worthless non-binding statutes.   I have looked some up of these illegal companies on sunbiz. org and a few are registered: whether they have the proper business licenses, let alone the required commercial insurance is debatable, but all will be revealed when Cory the keeper of the city records and scrolls, deciphers the ancient script, revealing collusion and corruption on a massive scale. Most appear to be operating illegally as transportation companies that lack proper medallions if any and are doing serious financial damage to my company, Abraxi Taxi. I would like to shut them down until they comply with what the city has put forward. We believe this is deceptive unfair and a breach of contract between these businesses and the city of Saint Augustine. It just comes down to levelling the playing field. And, have them pay us the maximum amount allowed in civil court. We have alerted the code enforcement division and the city commission for allowing this to continue for over many years and despite my repeated attempts for assistance, they have done nothing. Almost every transportation company whether cars, bikes or golf carts are not in compliance with the city code. I have made everyone at City Hall aware of these infractions but to no avail. Cory, our unofficial taxi commissioner, at the water department on Bridge street: keeps a record of all the transportation providers in the city. As an agent for the city manager she oversees hack and business licenses, then double checks for commercial taxi insurance and the master mechanics certification before accepting medallion payment. We can offer proof of our compliance for the past several years, but this office can also prove our case against all the other transportation providers that are operating as Gypsy cabs: if we are allowed copies of the information they have provided and on file. The city does send out notices for when medallions need updating. At just fifty dollars for the medallion itself the only reason not to buy one would be unsafe vehicles or lack of the proper insurances. Ignorance of the law should not be a valid excuse for criminal behavior. I think my only recourse is to file suit against the companies who most egregiously ignore these rules and regulations and does our company the most financial damage. I have exhausted all other options and since the city will not or can not assist us with this matter, we believe that our day in court is the last hope. We have a well-documented paper trail and in person appearances with the city commissioners, past and present assistant city attorneys, Cory and associates at the water department and the head of code enforcement. We believe that our exercise in due diligence has been exhausted, our hands are clean, and we have overwhelming evidence that our competitors are cheating. Along with rideshares many companies are operating without proper insurance, business licenses and of course the medallion required by the City of Saint Augustine. I will be attaching a copy of taxi medallion due notice and will also provide the complete statutes of the transportation code. We believe that our case is strong and will surely prevail with a favorable ruling. Steven Ciccantelli Owner Abraxi Taxi ...read more

WE NEED A CODE ENFORCEMENT SUPERHERO

Cory: Our unofficial and unpaid transportation director. I have explored all my options in trying to resolve my issues with all the illegal cab companies in town, I started with the mayor who shuffled me to the city attorney’s office. I have emailed the city attorneys who assure me all is well or maybe it isn’t, and we will just wait and see. But we will prosecute. I can document my paper trail for over two years and the few times I went to city council meetings where I was admonished by both a council member and the city manager. This year we do not have any hurricanes to blame, of course Abraxi taxi weathered both storms and had our city medallions those past two years. We have been setting the transportation bar very high since our inception and are becoming frustrated as our competitors try to limbo under the lowest rungs possible. These statutes need to be enforced now. The city, city attorneys, and Sax taxi colluded together to upgrade the vehicle for hire codes and regulations. This was put forward by Historic City News. And there was a resolution passed. From my understanding, behind closed doors, and a deal was struck to help form a monopoly. We certainly were not consulted. And in the end, this never materialized. Integrity won the day. Sax taxi went belly up on the ideas put forward in secret. My issues are that no one is being held accountable for either enforcing and policing the new policies approved by the commission. I have been more then patient in voicing my concerns and now am at the end of my rope. Since Sax taxi no longer exists and code enforcement and the city attorney’s office will not take my concerns seriously perhaps we should no longer have any regulations. The city cannot or will not ensure all local companies are complying. Some companies have not honored this policy for years. And like gypsy cabs are unregulated, dangerous and illegal. I also do not understand how you let ride shares operate here with no oversight. They cause congestion, break traffic laws and exploit the city codes I am required to adhere to. How can you allow them to use taxi lights, park willy- nilly with flashers on and transport our city guests with no rhyme or reason on who is working as a non-documented or fully insured driver? Let’s be honest there are little to non-existent background checks. And since they falsely claim they are not taxis, taxi dome lights should be outlawed. So please investigate my concerns that everyone else has ignored, albeit assuring me that I have nothing to be concerned with. It is past the time frame for medallions and I bet that the majority of taxi companies, pedicabs, low speed vehicles and the most egregious of all: hotel shuttles, again will thumb their noses at the city knowing that they will face no fines or penalties. My mistake in the past may have been going to the generals hoping orders would be whispered down the chain of command when as usual it is the NCOs non-commissioned officers who get things done. My next step may be the free press who has been somewhat critical of this city council in the past, or legal counsel to protect my business, our employees and the many tourists that visit the Ancient city. However, we would prefer that the police would start issuing warning then perhaps fines. Our intentions are not to embarrass anyone we just want justice. The new assistant attorney tried to assure me that he was no blower of smoke, but all I am getting from the city government are gale force winds with gusts of smog to either obfuscate my concerns or just hide complacency in plain sight, whilst we are transparent and compliant. Again, all we ask is for a level playing field and for those companies that can not or will not abide by the city edicts in my opinion their charters should be rescinded. Am I being naïve that thinking the city should protect local legal entities? So, Cory as acting taxi commissioner can you help us out. My managers and dispatchers are on my case as we can not keep drivers because these gypsy cabs are stealing food from their families. This has nothing to do with the state. These are regulations the city has dictated yet will not or perhaps is ill equipped to enforce. Perhaps you can find the correct department that controls enforcement as I have not had any success. We thank you for your time and realize that this is not exactly what you do but perhaps this letter might find its way to someone that can help us with this situation. ...read more
