TO BE OR NOT TO BE...

Is that the question? I suppose you are wondering, what in the world is this crazy woman writing about on her blog and what DOES Shakespeare’s Hamlet have to do with Legal Document Preparation and/or whether you can or cannot call yourself a paralegal without getting a “pow pow” from the UPL[1] police anyway? Absolutely nothing of course.  I guess, what I am really trying to say is...“WHAT’S IN A NAME?”So, you take several courses, go to college, get a degree in “Paralegal Studies” get certified through a nationally recognized accredited Paralegal program by studying your eyelids off, pass the exhausting two day multi-part exam (not to mention the hoops you have to jump through in order to meet the qualifications required to take this exam), the 50 hour continuing legal education credits you have to obtain every 5 years in order to keep your certification and yet, the UPL committee folks say you cannot call yourself a Paralegal UNLESS you are working under the direct supervision of an attorney.  Say what?!?!?!? In essence, as a business owner working independently, I cannot call myself a Paralegal even though I did complete all the aforementioned tasks AND have over 20 years of experience in the legal field working directly with various attorneys.  Unfortunately, because of this, I get questioned by our clients on a daily basis.  At least 30% of our clients are pro se litigants who have decided to represent themselves in court, most of the times simply because they cannot afford an attorney.  They are already nervous, scared and unsure of what is going to happen next.  So, when I send them the required “Non-Lawyer Disclosure” form, the following questions come up.  “Why are you sending me this non-lawyer disclosure form that says you told me you are not a Paralegal?  Aren't you a Paralegal? Should I be concerned?  Are you really going to be able to help me fill out my forms precisely like you claim on your website or are my forms going to get rejected by the court?”  What exactly is all this legal non lawyer disclosure mumbo jumbo? AHHHHHHHHHHHHHHHH!!!!!!!!!!!!!!!First, let me say that although it is frustrating to have to answer these questions, I understand where these folks, our clients are coming from.  It is however ridiculous for me to have to call myself a non-lawyer I mean, aren't we all non-lawyers? (Assuming of course that there are no attorneys/lawyers reading my article).  Let’s see.  My umbrella cockatoo is a non-lawyer but, she did not come with a warning label saying so.  My next door neighbor, a non-lawyer – the French poodle down the hallway, also a non-lawyer so, what’s with the non-lawyer bologna folks?  Yes, I get that I am not a lawyer and that I cannot provide legal advice yada yada yada but, I AM a Paralegal.  Is a Nurse not a Nurse whether or not she is working directly under the supervision of a doctor?  Ummmm…yeah but, she also knows that she is not allowed to practice medicine just like I, as a Paralegal know that I cannot practice law whether I call myself a Paralegal, a Legal Assistant, a Non-Lawyer or a Legal Document Preparer.                                                                              ...read more
