  1. Determine why the tenant is being evicted. It may be failure to pay rent, breach of lease or repeated violations. The reason must be valid under the local laws.

  3. After the time has passed, file a lawsuit with the courthouse if the tenant does not pay rent including late fees or does not correct any violations or breach of contract.


  4. Attend court hearing if the tenant does not comply. Be prepared for any defense that the tenant may give.


  5. If you win in court, most states will issue a notice for the tenant to vacate the property. A law enforcement officer will deliver the notice.
