Florida lawmakers must fix the 'assignment of benefits' crisis

Two of the largest bills that Floridians pay — home insurance and auto insurance — will continue to go up if lawmakers don’t close a major loophole that allows trial lawyers to milk the claims process for excessive fees. The culprit is what’s known as "assignment of benefits," or AOB. It allows home and auto owners to sign over their insurance rights to a contractor or vendor, giving them ultimate power to demand insurance companies pay for repairs resulting from hurricane damage, a leaky kitchen pipe or a cracked car windshield. This might sound like a time-saving measure, but AOB is wreaking havoc on Florida consumers, leaving many with shoddy repairs or no repairs made at all. Even worse, it’s forcing home and auto insurance rates to skyrocket. That’s because contractors and vendors far too often submit inflated repair bills to the insurance company, setting it up to deny the claim because of the overpriced estimates. When the claim is denied, the contractor or vendor teams up with a trial lawyer to sue the insurance company in the name of the policyholder. If they win even $1 more than the insurer’s original offer, lawyers can charge their fees directly to the insurance company. This gives them a powerful incentive to submit as many inflated claims as possible and dare insurers to challenge them. For example, lawyers in a Volusia County AOB lawsuit racked up $40,000 in legal fees over a $790 home insurance claim. And lawsuits over auto glass coverage, once almost nonexistent, ballooned to more than 20,000 cases in 2016, as billboard trial lawyers discovered how lucrative these small claims can be when combined with one-way attorney fees. Every person in Florida is affected by these types of abusive lawsuits. A report from the U.S. Chamber Institute for Legal Reform found that Florida’s tort system cost $4,442 per household in 2016. The state-run Citizens Property Insurance Corp., had to raise rates 8.2 percent on residential policy holders and 9 percent for commercial property owners. A recent study by the Insurance Information Institute shows just how bad the AOB crisis has become. From about 1,300 AOB lawsuits statewide in 2000, AOB litigation soared to 135,000 cases in the first three quarters of 2018. Legal costs gobble up five percent of total losses in Florida, roughly double the national average. And the result? Florida consumers paid $1.6 billion more for insurance over the past decade than they would have if they lived in another state. Florida’s AOB crisis has gotten so out of control that it’s attracting news coverage from national outlets, encouraging lawmakers to protect consumers from this legal scam. Thankfully, the Florida Legislature — with broad support from Florida Chief Financial Officer Jimmy Patronis — is signaling it wants to close this loophole. A bill in the Florida Senate would do just that by ending one-way legal fees and requiring contractors to submit estimates to insurers before performing AOB work. The bill would eliminate the perverse incentives for excessive bills and unnecessary litigation. Experience shows that these simple reforms will work. Lawsuits over automotive personal injury protection claims fell an estimated 12 percent after legislators passed reforms in 2012, such as excluding certain abuse-prone services like massage therapy from coverage and limiting legal fees. Florida lawmakers have the power to hand every one of their constituents the equivalent of a raise this year, if they can only muster the courage to oppose the trial bar.
