How to ensure that your legal papers get served without delay.

For most people, taking someone to court is a stressful activity. It gets more stressful when it gets dragged out. One of the things that can drag out a case, or even gets your case dismissed, is when it takes a long time to get the legal papers served on the other party. The sooner you can have your papers served, the sooner your case can roll forward, and the sooner you can resolve it and get back to normal. So, the question you need to ask yourself is, "How can I ensure that the other party gets served as quickly as possible." Here are some pointers to consider. 1. Do not brag or threaten to the other party that you are going to sue them. If the other party is likely to be uncooperative, all you are doing is giving them a heads so that they will know to look out for and avoid a process server. Be cool and just keep your mouth shut. It is easier to get your documents served if the other party is not expecting anything. 2. Collect as much information as you can that will help a process server to find and confirm that they have the correct party to serve. Ensure the address you provide is correct as most Process Server will charge a separate fee for each address attempted and for each party served. Provide photos of the person to be served if you can, personal identifying description of the person to be served, and a description and license number of vehicles that the party may own if you can. Provide as much information as possible as to the schedule that the other party maintains and identify family members or room mates that the process server might encounter. 3. Do not automatically expect the fee you are paying to cover unlimited number of attempts or extraordinary effort. You wouldn't expect that of FedEx or UPS, so don't be unrealistic regarding what you expect from your Process Server. Most services are fairly straightforward and most Process Servers will quote you a price based on a limited number of service attempts that, based on their experience, would effect service under normal circumstances. Should it be discovered that the party to be served is being difficult to find, or is actively avoiding service, you need to be prepared to pay for the additional effort to get the party served. Once the Process Server has earned the fee but has been unable to effect service, do not expect that they will now work for free. 4. If you are hiring a second Process Server after having already made attempts through the Sheriff or another Process Server, share this information so that your new Process Server can prepare accordingly. By being proactive in your case you can hopefully avoid many of the common problems often encountered in getting your lawsuit initiated and thereby eliminate needless additional stress.
