Owning Beachfront Property in Mexico There are many misconceptions about owning oceanfront property in Mexico. This is especially true in Baja because much of the properties being bought and sold are on the water. In this month’s newsletter, we’d like to take time to explain some of the legalities behind owning oceanfront property. According to the Mexican Constitution, the area of coastal land 20 meters above the high tide line is designated as the Federal Maritime Land Zone, or “Federal Zone”. In most cases they’re talking about the beach or the otherwise rocky shoreline’s of Mexico. This law was created so that all citizens and visitors have access to these areas for their own enjoyment. This does not mean that people can use the Federal Zone as they please. Activities such as camping or leaving trash are still prohibited, and can be considered a felony. Each owner of property abutting the Federal Zone must provide access to the public. That means a physical pathway has to be provided, and since most of this property is private, a legal right of way must be established. In Spanish this is called “Servidumbre de Paseo”, which literally translated means, “right of way”. SEMARNAT has the right to establish the location, dimensions, and other parameters of the right of way. SEMARNAT is the department of the executive branch which is responsible for setting environmental protection policies that aim to reverse ecological deterioration and promote sustainable use. PROFEPA is the prosecuting body that handles violations of environmental law. In order to make sure that a beachfront property is in compliance, it is suggested that a “voluntary servitude of passage” be established as per article 1109 of the federal civil code. In many cases such as in Todos Santos, the sellers of beachfront parcels have already taken this law into consideration when they subdivided their parcels. Many have established beach access points between every few lots so that the final purchaser can build without worry of violating anyone’s rights. When purchasing coastal parcels in Mexico, ask if public access passages have already been established by the previous owner. If not, a passage way can be created by having a surveyor identify the exact physical location of where the access will be. Then a Notario Publico must register the access way with the “Registro Publico de Propiedad y Comercio” or (Registry of Public Property and Commerce) for it to be considered valid and legal. When a property is transferred the Servidumbre de Paseo, or easement follows the property. It remains active until someone asks that it be removed. Building permanent structures in the Federal Zone are also prohibited. PROFEPA has been known to levy heavy fines for those that have built in the Federal zone. Concession permits can be obtained from the government to do business in the federal zone. If you are occupying property next to the Federal Maritime Zone be aware of this important law. Be sure when purchasing property that you understand and consider this aspect of owning oceanfront property in Baja.
