Short Sale in Orange County Good news for CA Homeowners: July 15th, 2011 Governor Jerry Brown signed SB 458 into California law which states that any lender agreeing to a short sale – which by definition will yield insufficient funds to cover the outstanding loans on a property – must accept it as payment in full for all loan balances. “SB 458 brings closure and certainty to the short sale process and ensures that once a lender has agreed to accept a short sale payment on a property, all lien holders—those in first position and in junior positions—will consider the outstanding balance as paid in full and the homeowner will not be held responsible for any additional payments on the property,” says CA Association of Realtors® President Beth L. Inspections and Appraisal on A Short Sale Purchase. When to do them

"Why Should I Invest in an Inspection and Appraisal on A Short Sale When The Bank Might Not Approve the Sale"When making an offer on a home that is a short sale (a sale where the seller's mortgage company or bank accepts less than what is owed) it is important to know when the timelines of the purchase agreement start.  In California, when using the California Association of REALTORS residential purchase agreement and short sale addendum, the timelines for completing most tasks (including appraisals and inspections) do not start until all the lien holders have agreed in writing to the terms of the contract and amounts they will receive. Therefore, it is advisable not to "invest" in an appraisal or inspection until all lien holders give written approval.  Once the written approvals are in place and assuming there are no changes by the lien holders to the agreement, then and only then should a buyer "invest" in the appraisal and inspection.  If a lien holder does not approve the terms of the purchase agreement and the buyer has spent the money for the appraisal and inspection, he or she would be out the amount of money already spent.Bottom line, in most cases in short sales, a buyer should not invest in an appraisal or inspection until all lien holders have approved the short sale in writing.For information onLa Mirada Short Salesor other transactions related to Fullerton real estate, La Habra real estate,Brea real estate, Anaheim real estate or NorthOrange County homes for sale please contact Carlos Barron at 714-982-2300. ...read more
