Can I Keep My Car if I File Bankruptcy?

Two of the biggest issues in every person's life is their car and their house.  I'm often asked, "Dan, can I keep my car if I file bankruptcy?"   For most of my clients the answer is YES! In a Chapter 13 Bankruptcy Case, whether you live in Knoxville, Sevierville, Jefferson City or Maryville, Tennessee we can make up the payments you are behind inside your case.  That means that even if you have a pick up order out on your car, usually we can file your Chapter 13 and help you keep your car. I've been filing bankruptcy cases in Knoxville, Tennessee for over 25 years.  In most of my Chapter 7 cases, if my client wanted to keep their car they kept it.  Usually we can work through a deal with the bank holding the lien on the car to do what is known as a "reaffirmation agreement."   This means you still owe the debt, but you keep the car.
