We went over whatI wanted out of the case and what my option where. He was respectful and kept me informed the whole time. Originally we thought my BAC was going to come back at roughly a .16 but upon my toxicology reports coming because my BAC was at almost a .21! this was a little nerve racking. Divorce vs. Dissolution

We are often asked what the difference is between a divorce and a dissolution (not “dissolutionment”). Both are a legal process to terminate a marriage. Both processes require the parties to disclose and divide all property and debts and set forth spousal support obligations. Further, if the parties have children, both processes also require the parties to allocate parental rights and responsibilities and set child support. After all is said and done, both are orders of the court that can later be modified or enforced. However, the primary difference between a divorce and dissolution is how involved the court is. In a dissolution, the parties are able to come to an agreement as to all terms for ending their marriage. The agreement may have been reached through the parties themselves, with the help of their attorneys, or through some alternative dispute resolution like private mediation. To divide their property and debts and set forth spousal support obligations, the parties enter into a Separation Agreement, which gets incorporated into the Decree of Dissolution. If there are minor children involved, custody and child support might also be allocated in those documents, but the parties may agree to shared parenting and enter into a Shared Parenting Plan, which is incorporated into a Decree of Shared Parenting. The final hearing can be done at the court house or through the use of a private judge. However, when the parties cannot agree on everything, they file a divorce. A divorce signals that the parties need the involvement of the court to help resolve issues of their property, debts, parental rights and responsibilities, or support. Although it is considered more adversarial than adissolution proceeding, it doesn’t have to be. The parties may end up in trial, where the judge or magistrate will make a decision about how to deal with those issues, or the parties may end up settling their issues while the divorce is pending. If they settle, the parties can request the court to adopt their settlement agreement and make it a binding order of the court through an uncontested divorce hearing.
