Hired Peter for a job last fall which went as well as could be expected considering the weather we experienced early in 2013. Booked him for work in November of 2013 for the following spring for the front of my home and some finishing work in the back yard that we ran out of time on. In early 2014 I contacted him to remind him of our commitment the previous season and asked to be put on the calendar as early as possible. He came out in April, canvassed the areas, bid the job and accepted a hefty deposit during that visit with a promise for May work and to replace all the plants that didn't survive the winter. May came and went and when I contacted him with a start date he indicated he was hesitant about doing the job because he was fenced out of the back yard (We had a new fence installed in the fall of 2013 and at no time did he request that the gate be left off pending the work he committed to do in the following spring). He then sent me a text indicating that he "doesn't feel comfortable moving forward with any of the work at this time. Too many red flags. We are swamped busy and we don't have the time to hand dig a patio base. I will drop your deposit off to you tomorrow." Even though I selected pavers for the back yard in April, he was aware of the gate being there, he bid the job and accepted the deposit for a May work time line. Needless to say, I was very disappointed. The refund did not arrive the next day as he indicated, I had to text about the status and a time line for plant replacement, he replied, "ASAP I'm sure" and wanted to know what the plants were that were dead, as though I am a horticulturalist.... He took 2 weeks to send me a check which was short 1000.00. Yes you read right, One Thousand Dollars! I had to threaten litigation if he did not correct the unpaid balance and replace the items. He stated "there is no guarantee on plant material..." After threatening litigation, the 1000.00 balance was dropped off at my home, the plants were placed, even though two obviously dead plants were missed (there were 8 total) and he did nothing with the items he transplanted that were already there when he did the work, and were healthy and thriving prior to being transplanted, and are now dead. Booked Peter in Nov 2013 for early spring 2014. Had to contact him as I never heard from him. Bid and accepted job in April 2014 for a May start date. Cancelled job without notice citing he was too busy, didn't have time to dig a patio base and would return my hefty deposit. Had to call about status of refund and replacement of dead plants. Deposit mailed, and was short by $1000.00. Had to threaten litigation to receive balance of deposit and plant replacement.
