The first advantage is avoiding legal costs and attorney fees if you find yourself in divorce court later on down the road. A lot of your money, and property will be lost to your spouse. A second advantage of a Prenuptial Agreement is you can make sure family assets are immune to claims from the new spouse with a Prenuptial Agreement. Your business for example. The third advantage of a Prenuptial Agreement is protection against creditors. One spouse may have a lot of debts before the marriage. You can get a prenup to protect your form your new spouses creditors by having the debtor spouse sign a prenuptial agreement. This will waive the debtor spouse's claims to the new spouse's assets. Will’s and Living Trust

Will’s and Living Trust Living Trusts and Will’s are actually both estate planning tools, but there is a different use for both. What’s the distinctions between these two documents. What Will’s do: Wills are used to distribute your property to your beneficiaries after your death. Your also able to appoint an Executor who is responsible for managing your property after your death, making sure that your beneficiaries get their designated assets. Example of something you might have in your Will would be to appoint a Guardian your for children. Will’s are made during a person’s lifespan but, is only operative after death. What a Living Trust does: This document is different from a Will.  It can be effective during a person’s lifespan. Where willsare an after death document. Your can modify it during your lifetime. It is actually similar to a Will in that it enables you to manage assets that change though out your life. You are able to choose how assets are distributed following your death, and a Successor Trustee who will assist to manage, and distribute your belongings. A Successor Trustee is able to manage the assets and help you with financial affairs should you become unable. This is why your creating this legal entity. You may be still alive, just unable to manage your own affairs. Do I need both a Will and a Living Trust? I think so. It is beneficial to set up a Will since you will be able to choose how your assets will be dispersed after your death. It is also better if you create a Living Trust in case you should fall ill, and not able to do it for yourself. Both documents can be beneficial. It is possible to do your own planning.
