Got an Original Creation? Protect It with a Patent

Have you always wanted to become an inventor? Inventing is a rewarding process as it means you are a creative individual. Imagine if the whole world knew your name because of your fantastic invention. But what happens if someone steals your idea? All your hard work, gone. So, how do you protect your original creation and ensure only you have the rights to it? Before you can share your invention with the world, ensure it’s protected with a patent. The Patent Process  There are three parts to the patent process. First, you must conduct a global search to ensure your invention is original. Next, you’ll need to fill out a detailed patent application then file it with the United States Patent and Trademark Office (USPTO). Finally, USPTO will review and either approve or deny your application. This process may take years. Once obtained, patents typically last for 20 years. Lastly, there are three different types of patents: utility, design, and plant. The type of patent you’ll need depends on the object you’re trying to patent. A utility patent protects machines, manufactures, compositions of matter and the process these inventions were made. A utility patent can also cover new improvements to things already inexistent. While it may seem strange for the patent to protect the process, this keeps the object and its creation a secret and discourages knock-offs. Design Patents A design patent is defined as the “surface ornamentation” of an object. This can include both the configuration and its shape. To get a design patent, the design must be inseparable from the object. While this is the case, a design patent only protects the object’s appearance. To protect the structure and function of the object, you’ll also need to apply for a utility patent. Plant Patents As the name suggests, a plant patent protects the discovery of an original plant. There are several requirements needed to obtain this patent. First, the plant must not be a tuber propagated plant, the plant must not have been found in an uncultivated state, and the plant must be able to asexually reproduce, meaning not with seeds but by cutting or grafting the plant.
