My Ex Wants to Lower Child Support in New Jersey, What Can I Do?

Client came into my Jersey City office last week with papers from her ex that pays child support seeking a modification of his child support obligation because he has another child that he takes care of. This is known as the other dependent deduction and certain criteria must be met to be able to make this claim. Having another child alone is not enough to reduce your child support obligations. First to claim this deduction you have to prove you are paying child support through the courts or that you are residing with the child and that the child is yours. You also need to show the income of the mother so that a child support number can be calculated and entered into the child support guidelines for the case you are currently seeking a reduction in. Again, this is not automatic even with having this information. Your income may have gone up, you may have less overnights than when you first calculated child support and because of these other factors, the support amount may actually go up. It is smart to work with an experienced family law attorney to protect your interests in family court especially when it comes to child custody or child support. If you have a family law case in New Jersey and seek an experienced legal team to represent you, contact theArtusa Law Firmon 973-337-9643. ...read more

How Long Does a Divorce Take in New Jersey and Why?

People call or enter my Jersey City office and ask me how long divorces take in Jersey City or in New Jersey in general and it really depends on many factors. As aNew Jersey Divorce LawyerI have seen it all, from the easiest of cases gone wrong to the toughest cases settle quickly. The main factor as to whether a New Jersey divorce takes 6 weeks or over one year is whether the parties agree on the issues if there are any issues at hand. Aside from that, knowing where your spouse is will make the case move faster as will if your spouse signs and waives his or her right to any relief or agrees to the relief sought by you. The cases that tend to take the longest are contested cases involving residential custody of children. With that issue comes expert testimony and then more experts testify and this makes the whole process very long and very expensive. Whether you believe your case will be quick or long, my team and I can handle the case. Contact the Artusa Law Firm on 973-337-9643 to further discuss your options. ...read more
