COMPLIANCE AND TECHNOLOGY04/15/20140 Comments Surely a great  portion of the transportation industry market has heard of or uses an app based ordering system for requesting transportation services, ordering food delivery and all kinds of services. Fancy, Grub hub and Seamless dominate the market in food ordering. Uber, Lyftt and Gett have captured a great part of this fastly trending and here to stay,  app based transportation services request, market.  Uber declared revenue sales in excess of a billion dollars for last year and has captured markets in 37 countries around the world. Lyft and Gett taxi also own large sections of the market. Which is poised to be a 14 billion dollar market within the next 2 to 3 years. Wonderful, right?       Not exactly, while app based ordering of everything from food delivery to consumable goods is trending with little or no obstruction, the same can not be said for ordering transportation for hire services. Such as the services provided by Uber, Gett and Lyft. On demand Sedan transportation services have a myriad of difficulties to contend with. Namely state and city regulations imposed by government.  The rapid growth of these companies is due greatly to their blatant disregard for state and city regulations. Which have caused a great deal of law suites against Uber and Lyft.          These law suits arise from their blatant disregard for regulations, but in the courts they loose clarity, some justices have ruled in favor of Uber and Lyft as if they had totally lost sight of the reason why they were being sued. So far they have been portrayed as poor little entrepreneurs that are being  sued by their competition that is trying to hamper their growth. Not, say most if not all that have sued the trending giants. The problem and the reason they are being sued is because they are disregarding every single ordinance and regulation established by law.1) A for hire vehicle has to be insured for at least 500k to 1.5 million dollars per incident per passenger.2) The driver has to have a Hack license (for hire drivers license) average cost of about 350.00 per year.3) The driver has to pass a criminal background performed by the police department of their city or state, which includes finger printing and drug testing.4) Zones regulations in general  forbid certain types of for hire transportation vehicles fromoperating outside of their zones. Ex. There are 4 major classifications of for hire transportation vehicles, Taxi, Black Car, Limo, and shuttles, we will discuss Taxi, Black Car and limo and how they are affected by zone regulations:A taxi from NJ, can drop off  anyone in any city, but he cannot pick up a passenger in New York on demand (flagged). Nor can he or she do a local service calls in NY. ( if they are caught doing so he or she can be fined up to 1,000. not to mentioned revocation of his hack license and getting their car impounded.)    The same is true for a Black Car and limo operator who is subject to a different set of rules to go by including the zoning regulations, in short a Black Car driver is forbidden from  doing local calls (calls within his city of operation) nor can he pick up flags (on demand) from any city. They are to operate by reservations only and  from town to town only.The price of the fare being pre established, a  flat rate, at the time of reservation and not determined by meters. Unlike a taxi's. If a person is going to the state or city where the Black Car operator is authorized to operate then it is legal for them to pick the passenger up so long as the passenger has pre-arranged the service call with the driver or the dispatch center (company). The same is true for the limo drivers, (limo service refers to the service provided and not the vehicle, although most limo service are performed by late model luxury sedans)    This brings us to subject matter of this article. When a company circumvents all  regulations and  ordinances they are indeed in violation of the law which of lately seems to escape even the very people entrusted with enforcing the law. How you might say, let's use the government vs. Uber, the judges ruled that the reason Uber was being sued was because their competition wanted to a destroy the budding entrepreneur. When in fact the issue was that the Ubers' pricing system was based on GPS recording of times and distances for the pricing model. No problem there right... There is a problem when  the operator was not compliant meaning they did not have for hire insurance nor did they abide by zoning laws. Giving Uber, Lyft and Gett an unfair advantage.     Let's elaborate, if an operator doesn't not have to pay 750.00 dollars a month for (passenger insurance) nor does he abide by the zoning laws, nor pass a true background check, his operating costs are lower, so working with Uber pricing model is not a problem for him but it is unfair to the operators that work in compliance with all the regulations. There is no way that a company can be compliant and charge low fares. Which is indeed the core driver of, Uber, Lyft and Gett,  their success coupled or basically driven by the technology they are using. Most of their fleet is non compliant lacking in the proper licenses and insurance as well as violating zoning laws concerning Taxi,limo ar black car services. There is no law to forbid one from giving people rides in their personal cars nor against receiving payment for it. But there are laws governing for hire vehicles services concerning the proper vehicle insurance and the operation zones. That is where the problem comes in and that is where compliance gets tricky.      In view of this dilemma and the lack of enforcement  by regulators and law enforcement alike what is a company to do. Continue to operate within regulations rather than fight the companies that don't. Stay compliant and make sure you abide by all the rules even if you operate using similar technology as well. Eventually and I mean  soon by default the same way that this technology is trending is the same way that it's flaws will surface. Do get political and fight for deregulation don't sue Uber sue the government. Uber's is setting the same legal precedents that will be later used in the defense of your company, should you be faced with legal actions. ...read more
