When Can I File My Tax Return?

For most people, the IRS will begin acceptiing e-filed returns on January 18th.  It's important to remember that you must have all of your W2s and other income tax documents before you can actually file your return.  Employers aren't required to send the W2s until January 31st.  You can't file a return with a substitute W2 until much later so please be patient.  When Congress passed the new tax law recently, it made some changes to the 2010 tax rules and some people won't be able to file their returns until mid to late February.  If you need to file any of these forms, your filing will be delayed: Schedule A:  That's the itemized deductions pages.  If you own a house you probably file a schedule A.  The change is that people can claim state and local sales taxes instead of state income taxes as a deduction if they want to.  It was a law that was supposed to expire but just got reinstated by Congress.  Even if you don't claim state and local sales taxes, if you file a schedule A, you can't submit your return until mid to late February. Another deduction that was supposed to expire was the tuition and fees deduction claimed on form 8917.  Now if you claim the American Opportunity Credit (used to be the Hope Credit) or the Lifetime Learning Credit for education expenses, you're still okay to file on time.  It's just the tuition and fees deduction that is delayed. And the third thing that might hold up your tax return is the educator expense deduction.  It goes on line 23 of your form 1040.  If any of these deductions normally belong with your tax return, you'll have to wait until the IRS announces that they can be filed. Please understand that it's against the law for an authorized e-file provider to submit a tax return without having the W2s.  Don't be angry if you take your taxes to a professional and she can't file using your paystubs.  There are severe fines and penalties to us if we do that. ...read more

Sales Tax Holidays

Hey parents!  August 6th is the start of the back to school sales tax holiday for both Missouri and Illinois.  So what's exempt from sales tax this weekend?  In Missouri, the holiday runs from August 6 - the 8th.  Here's what's included. Clothes-- any article of clothing having a taxable value of $100 or less.  So you can buy $500 worth of clothes, it's just that each piece has to cost less than $100. School supplies--not to exceed $50 per purchase. To be honest, you can easily spend over $50 on school supplies.  Two solutions-hit both Office Depot and Walmart, or hand cash over to your kid to be a separate shopper. Computer software--with a taxable value of $350 or less. Personal computers and also computer peripheral devices-not to exceed $3,500. The best part?  You don't even need a kid to take advantage of the sales tax holiday.  If you need these items, now's a good time to shop. For you Illinois folks the sales tax holiday runs through August 15th.  There is a very specific list of what does and does not count for the sales tax holiday and it's seven pages long so I'm just attaching a link.  Have fun shopping.Illinois shopping list ...read more

Wesley Snipes Conviction Upheld

Wesley Snipes can't seem to get a break.  Although his lawyer argued that the penalty was too stiff, a federal appeals court upheld his three year prison sentence for not filing his taxes.  Snipes claim that he is an idealistic artist and not schooled in the science of law and finance didn't faze the judges.  (His lawyers should know that's not a legitimate defense.) If you happen to be a movie star making millions of dollars a year, here's a tip:  you need to file tax returns.  Even if you're not a movie star and you make substantially less money than Mr. Snipes, you probably still have to file.  Granted, the vast majority of people who owe the IRS money don't go to prison, but you can still get hit with fines and penalties for not filing.  Bottom line:  if Wesley Snipes had called me 10 years ago, he wouldn't be headed towards prison today.  Sounds pretty outrageous, but it's true.  If you're getting IRS notices, don't ignore them.  Get help today.
