We eat at Zio's in San Antonio about 3 or 4 times a week as it is close to our house and the food is great. However, there is one waiter who is very rude (Kevin) and we ask when we go in to be seated in someone elses section. Today while eating with my daughter and two grandchildren Kevin came to the table and yelled at us because we don't every get him as a waiter. It was so loud and rude that the people at the tables around us all spoke to us about it and were shocked also. We spoke to the woman manager and hopefully this will not happen again. To the Department of Human Resources, I am writing this letter to lodge a formal complaint against my former boss, Mr. Ramon Hernandez. I feel that I have been given unfair treatment upon working under Ramon. I had been an employee of Zio’s for a total of four years. After John Everett left, everything changed dramatically. I regret to inform you that I have been a witness to, and victim of, harassment in the work place under the management of Ramon. I have been told by Ramon personally that he does not like me. I have heard him talk down to other employees on many occasions, most prominently women. I am also aware that Ramon has been illegally cutting employees hours in order to meet labor requirements. He is also not paying some employees the hourly pay he is required to, again, to meet these labor requirements. (i.e. not letting servers clock in until they receive their first table, not paying openers minimum wage for the extra hour they are there, etc.) He had asked me at one point if I would close the lunch shift for him because another employee had to leave early (I was tending bar at the time). I agreed that it would not be a problem. However, he told me that I needed to clock out as a bartender and clock back in as a server (mind you, I was still performing bar duties throughout the day and was not getting paid adequately for it). I’ve enjoyed very pleasant employment at Zio’s over the past four years, since the day the Norman location opened under the management of John Everett. I have formed very close working relationships with co-workers and overall enjoy the environment that Zio’s provides. It has only been under the management of Ramon that I have experienced a hostile working environment. I appreciate your attention to this matter. Server Justin V. did a horrible job serving our party this evening. I was not pleased with this and this was my daughter's birthday dinner. Never got a refill during the two hours we were there.
