Why You Should Take Indiana DUI Laws Seriously
Indiana DUI laws are meant to be obeyed and followed; when you are arrested for driving under the influence, you can expect to face harsh penalties. This is a criminal offense, and if you are convicted it will negatively impact your life in many ways. If you do not know and understand the Indiana DUI laws, the information below will help inform you so that you do not make the mistake of breaking these laws. In the state of Indiana, it is against the law to drive a vehicle when your BAC or blood alcohol concentration level is .08 percent or higher. If you are under the age of 21 or drive a commercial vehicle, the laws regarding DUI are even stricter. If you are caught driving under the influence and it is your first offense, it is considered a class "C" misdemeanor. Another of the Indiana DUI laws you may not be familiar with is the implied consent law. This law simply states that all Indiana drivers agree that if stopped for suspicion of driving under the influence, you will submit to a chemical test of your urine, breath or blood. If you do not agree to take this test your drivers license will be suspended for one year. No one wants to lose their right to drive, and this is particularly disturbing if you drive a commercial vehicle or driving is an important and essential aspect of your employment. Failing to adhere to Indiana DUI laws can cost you severely, not only in steep fines and court costs but in marring your reputation and possibly landing you in jail. Depending on the circumstances, you may have a criminal record or be forced to place an ignition interlock device on your car. Even if it is your first offense and your BAC is found to be between .08 and .15, you may be facing 60 days in jail and up to $500 in fines. You could also lose your license. As you might expect, penalties become more severe with each subsequent offense. While it is essential that you respect Indiana DUI laws and avoid getting in to serious trouble or even becoming involved in an accident, contact a reputable attorney should you get arrested for driving under the influence. An experienced DUI lawyer in Indiana understands these often complex laws, and will work to use them to your advantage. Stark Law Offices, Criminal&DUI Defense 201 N.
