Q: I received unemployment benefits, but now workers’ compensation has paid me the weekly wages.  Am I entitled to both? A: No.  An injured employee is not permitted to receive workers’ compensation benefits and unemployment benefits at the same time.  For any time period you received both unemployment compensation and (now) workers’ compensation wages, you will need to pay unemployment back the amount it paid out.  However, this should not result in you owing additional money, as unemployment pays at a lower rate than workers’ compensation.To read more about Workers' Compensation click: http://www.woodrufflawyers.com/workers-compensation-overview/ ...read more

Q: If I’m asked whether my injury is work-related when applying for unemployment, should I say no? A:  No.  Injured employees often fear they will not receive unemployment compensation when they are not working due to their work-related injury.  It is true that unemployment does not want to pay benefits that should be paid by workers’ compensation, but this typically can be resolved with a letter from workers’ compensation stating benefits are not being paid.  Stating an injury is not work-related only harms your chances of recovering your workers’ compensation benefits down the road. FAQ: Regarding Workers’ Compensation and Unemployment

Quick answers to some of the common questions we receive regarding the interaction between workers’ compensation and unemployment. Q: I suffered an injury at work and workers’ compensation isn’t paying me weekly wages.  Can I apply for unemployment? A: Yes, provided your treating physician has you on light duty restrictions, and your employer either cannot accommodate your restrictions, or you’ve been terminated.  In order to be eligible to apply for unemployment, you must be able to perform some form of employment.  Therefore, if your doctor has you off work entirely, you aren’t able to perform any work, and you would not be eligible for unemployment.  Additional eligibility rules and requirements for unemployment apply as well. ...read more
