Structured Settlement - What is that?
For most of the world a structured settlement is a meaningless word that from time to time will hear on an obnoxious television commercial, however for the 10 of thousands of plaintiffs who have settled lawsuits this is a word that provides comfort to themselves and their family. Nearly 30 years ago, when someone settled a lawsuit, there was typically one option. That option was that the plaintiff would receive a lump sum payment in exchange for settling the lawsuit with the defendant. As years past, the drain on insurance companies thrust a lot of these companies into making different decisions when considering a settlement. The decision was to settle for the amount or near the amount asked for by the plaintiff, however the amount would be structured over a period of time. Hence the word structured settlement. By paying the plaintiff over a period of time the insurance company is able to buy an annuity policy for a much smaller amount that will grow over time and pay out the larger amount to the, now annuitant. The insurance company is reasonably satisfied because they have settled the case for a lesser amount then was asked originally and the annuitant is now happy as they received the amount they asked for (although structured over time) from the defendant and they now can move on with their life. How often do people choose a structured settlement? It is hard to say how often a structured settlement is the approved method for paying a lawsuit settlement, however the structured settlement industry has theorized that there are billions of dollars in structured settlement payments currently and the number is growing at about 20 million per year. We are in very litigious times, so it is easy to see why there are so many structured settlements, because the insurance companies can't keep up if they have to pay out a lump sum in every lawsuit. While some will fight for the lump sum at the time of the settlement, there are many who will want the suit to be over and will settle for a payment stream over time. For those that have received a stream of payments from a structured settlement and want to access some of the cash now, there are very few options available. Since the annuity is fixed, the only choice is to sell structured settlement payments to a third party in exchange for cash.
