Social Media and the Workplace

Social media is a new and difficult issue for employers. While an employer can take steps to protect the company and supervisors through written policy, it must be carefully crafted. During the fall of 2010, a National Labor Relations Board (NLRB) regional office issued a complaint against an employer under similar circumstances. In that case, the employer's electronic media policy prohibited employees from making disparaging comments about the company or supervisors. It prohibited the employee from depicting the company "in any way" online without prior permission. The NLRB complaint argued that the employer's electronic media policy was too broad and infringed upon the employee's rights under Section 7 of the National Labor Relations Act (NLRA) to engage in concerted action, specifically to engage in discussions with co-workers on working conditions. Break Times for Nursing Mothers

The requirement to provide break time and a private location (other than a restroom) for employees to breast feed infants became effective on March 23, 2010, upon the enactment of the PPACA. The Department of Labor (DOL) has issued a fact sheet providing guidance (www.dol.gov/whd/regs/compliance/whdfs73.htm). However, on December 21, 2010, the DOL issued a "request for information from the public" (75 F.R. 80073) about the requirement with comments die in February. Hours of Work

The federal Fair Labor Standards Act (FLSA) requires that employers pay employees a minimum wage for all hours worked and an overtime wage for hours worked over 40 in a week. In general, hours worked for purposes of the FLSA includes all time that employees spend performing activities on their employers' behalf. Hours worked also includes waiting time, travel time, other than time spent commuting to and from the employee's regular place of work, breaks or meal periods that are less than 20 minutes long, and time the employee is required to spend in training, at seminars or in meetings. Hours worked for purposes of the FLSA do not include waiting time, time spent on call or time when an employee is required to carry a pager or cell phone, provided the employee is otherwise free to effectively use the time for his or her own personal purposes. The FLSA does not obligate employers to pay employees for holidays, vacation or sick days.The FLSA requires that employers keep accurate records of hours worked and wages paid. The statute does not limit the number of hours employees may work in a week, except in the case of minors under the age of 16.
