Factors the Courts Take into Account When Granting Custody

As divorce attorneys, child custody law questions often arise when our clients begin the marriage dissolution process. The most common question we hear is: What custody laws affect my rights as a divorcing parent? First, you need to know that there are no local child custody laws—such matters are governed on a higher level. When you want to know where you stand regarding mother or father custody, you must look to Florida's state laws, not to local city or county laws. However, since many of our clients come from Orlando and the cities and counties in the nearby area, we will discuss your parental rights based on the perspective of the region. Joint custody In Orlando, joint child custody is the most common decision a judge makes because Florida does not take the view that granting sole custody to one parent is in the best interest of the child.  Unless there is a specific order that gives one parent sole physical custody of a child, each parent in Florida has equal custodial rights.  Parents are encouraged or—in the absence of an agreeable parenting plan—ordered to share in the responsibilities of raising the child.  The difference between the time that the parent spends with the child or children is determined by a formal Parenting Plan and Contact Schedule that is part every final judgment in Florida family law cases. Father custody We generally advise fathers to expect sole custody to be neither a concern nor a hope.  Fathers are unlikely to be denied custody, and are just as unlikely to be awarded sole custody. However, if a judge believes that it would be detrimental to the child for one parent to participate in decisions concerning the child, then the other parent may be given sole parental responsibility. A warning about Orlando temporary child custody One cautionary consideration for our clients in Orlando—"temporary" custody often has long term or permanent implications. Temporary custody is often necessary because, when going through the often laborious process of divorce, the custodial needs of the child often require prompt action on the part of a guardian. A temporary custody order fills that gap, helping you secure your child's custody until such time as the divorce is finalized, along with the final custody. But the terms of the Orlando temporary child custody plan often informs future legal judgments, such that the terms of the temporary plan often become the terms of the permanent custody plan.
