Avoid Arrest - Invoking Your Rights (How to Behave Around the Cops)
Remember that scene in Basic Instinct when sharon Stone's character sat on her balcony and told the cops to either arrest her or "get the *$#! of my property"? Well, her profanity aside, her act of asking law enforcement to specifically articulate their business was well-played. If members of law enforcement approach you, ask them if you are detained. If they tell you that you are not detained, continue on your way. On the other hand, if they tell you that you are not free to go, this means that they have already formed, or are claiming to have formed some reasonable suspicion of criminal conduct that they can articulate. Be calm, be respectful. Ask for a lawyer. Let them know that your first objective is to invoke whatever rights you have, and that you want to do so respectfully. When you are detained, and ask for a lawyer, you are letting law enforcement know that it is your desire to invoke your rights, even though you don't necessarily know what your rights are. If while you are detained, the cops ask you questions, again ask for a lawyer. Constantly, and calmly let them know that you would like to invoke your rights, and that you would like to have an attorney. Here's why: Many court room hearings involve accused criminals listening with shocked facial expressions as the officers that detained and searched them testify that the entire encounter was consensual, and that "the defendant was free to go, but chose to hang around and confess ownership of the big bag of coke in the trunk of the car instead, "Your Honor". Finally, if you are arrested, this means that the cops are taking the position that they have probable cause to believe that you have committed a crime. Remain calm, ask for a lawyer, then shut down. Again, ask for a lawyer, and say nothing else. Think of Sharon Stone's character on that balcony, but without the profanity. Take this very seriously. Stock Market Losses? - Filing a Claim to Recover
Initially it is tempting to compare investing in the stock market to gambling in Las Vegas. The chief difference, however, is this: When you do business with a major brokerage firm, you are paying them, in part, to evaluate your risk tolerance and make sure that your money is invested in a manner consistent with that level of risk.(A twenty-two year old college graduate will probably have a different level of of risk tolerance than a retiree on a fixed income.)Along these lines, the majority of people who sustain stock market losses are accountable for their own losses, and are therefore unsuccessful when they file claims against their stock broker. On the other hand, it is the broker's(adivsor's/consultant's) job to help a client make fully informed decisions, again in a manner consistent with his/her risk tolerance. Investors who are able to show that their money was not invested in such a manner are more likely to be succesful filing a claim to recover.If the value of an account you held at a brokerage firm decreased substantially, and you feel that this decrease was not the result of a fully informed decision made by yourself, - or you feel that your investments were not suitable for your account, you may file a claim to recover. Normally this involves going toarbitration.(check your brokerage firm's account opening paperwork for the "Arbitration Clause".) Arbitration is a little less formal than a normal legal hearing or trial. The decision maker is either one person, an arbitrator, or a panel of arbitrators. This panel will listen to your claim, as well a any defense presented by the brokerage firm, and subsequently make a decision on the merits.In the time leading up to an arbitration, both sides may agree tomediation. Mediation is less adversarial than arbitration, and as it is voluntary, the stated goal is to reach a compromise.With these briefly discussed concepts in mind, recognize that youalone are the captain of your ship, and a penny saved is a penny earned.
