I hired Max to help me dispute a fraudulent charge from a leasing company. Upon moving, the leasing company charged me for damaged carpet that was caused by thier maintenance personnel. I explained this to Max, he charged me $500 to handle my issue. Weeks later, Max told me that he spoke with the corporate office as my "attorney” and the company released me of the carpet fees. He said that he sent the release to the 3 credit bureaus so they can remove the charges. I asked for a copy of the release of which he has NOT sent me. I later received a call from a debt collector for the carpet. I called Max for weeks, when I got a hold of him, he told me to give the debt collector his number and he will handle it. The debt collector was unable to reach him. He took my money and never sent me any documents and the creditors never received any information from him. I would NOT recommend using him for any services!!!! If he happens to respond to me, I will write a follow up review. ...read more

Two New laws affecting Florida's Construction Industry

There are two new bills that you should be aware of. The first bill is House Bill 599 which deals with Public Works Projects. The hyperlink to the bill, which was signed into law by the governor is found below:   https://www.flsenate.gov/Session/Bill/2017/599/BillText/er/PDF   The theory is that the amendment will provide a more competitive bid process for public construction projects where state dollars represent 50% or more of the funding. Prior to this bill, local governments could establish arbitrary pre-bid mandates on contractor's telling them who they must hire, where they must train and what benefit packages they must offer if they want to bid the job with that entity. For many small businesses, these mandates made it unaffordable to bid on many public projects. The premise is, increasing competition will benefit Florida taxpayers.   The second piece of legislation of consequence is House Bill 377 which deals with limitations on lawsuits other than for the recovery of real property. A hyperlink to the legislation is found below:   https://www.flsenate.gov/Session/Bill/2017/377/BillText/er/PDF   What this bill hopes to accomplish is to clarify when and how Florida's 10-year statute of repose begins to run on a completed project. The statute of repose defines the period in which an owner can sue for alleged construction defects. In a number of recent cases, a final payment was not made for construction costs. By making final payment late, the repose period was effectively extended beyond the 10 years envisioned by the Florida legislature.   The pertinent language now states:   Completion of the contract means the later of the date of final performance of all the contracted services or the date that final payment for such services becomes due without regard to the date final payment is made. This act applies to causes of action that accrue on or after July 1, 2017. If you have any questions please feel free to give me a call. Christopher Weiss Attorney at Law, P.A. Traditional Notary Public or "Independant Notary Public" ?

The private Notary Public  or "Independent Notary Public" as I like to refer to them have been around for a long time now. The "private independent notary" is that notary that does not work for an institution like a bank or in a law office working for a lawyer.      Traditionally notaries employed by institutions like banks or under the umbrella of an attorney's office have rendered notarial services as a form of collateral or support services. In the case of banks, bank notaries have assisted their customers by facilitating personal and business transactions by notarizing documents for free or for nominal fees. Important to note that bank notaries derive salaries or wages from the employing bank.      In the case of notaries that work for a private attorneys, these notaries frequently notarize documents for the clients of their employer attorney, here the notary provides a collateral service that facilitates the attorneys law practice and simultaneously makes it possible or easier for the attorney's client to have his signature notarized without having to seek the services elsewhere, hence providing "one stop service" for the client. Notaries that work for attorneys, like their bank counterparts are financially compensated by the employing attorney.      In contrast the modern "Independent Notary Public" usually works out of his own private office at a retail location or many of these notaries operate what are "mobile notary services" where the notary will travel to a home, a business or even hospitals where clients may need notarial services rendered. The "Independent Notary Public" generally works for himself and usually by himself, and without the supervision of either the banking institution or of the private attorney.  The "Independant Notary", unlike the the two types of notaries mentioned prior, receives no salary or wages from an employer.       These "Independant Notaries", many times in order to be able to continue to make their independent notaries services available frequently must sell or provide other services like typing legal document forms, faxing , copying documents, tax preparation and even finger printing and passport photos. All these services are rendered with the goal of generating additional revenues that help support and maintain the "Independant Notary's" business or practice. Hence insuring that "Independant Notaries" will be able to exist and be available to provide notarial services to private clients that can't access banking institutions or are not under the services of an attorney. It is for this reason that " Independant Notaries" must charge for thier services, sometimes at rates that retail customers find expensive or "high priced" and thus objectionable.        In conclusion I exhort future customers seeking retail notary services from "Independant Notaries" to keep in mind the circumstances and differences between the bank notary, the law office notary and the private " Independant Notary Public", and to understand why private independent notary fees are what they are.
