Who Seeks to Establish Paternity in Florida? Father's Seeking to Establish Paternity & Timesharing Rights In the State of Florida a either parent of a child may seek to establish paternity. It's very common for unmarried fathers to be the subject of paternity lawsuits and similarly for unmarriedfathers to seek to establish paternitywill enable them to enjoy the benefits of timesharing or custody of their child. Unmarried Mother's Who Need Child Support Single mothers in need of the father's financial help and who file for child support are often the ones who initiate paternity cases. By virtue of filing for child support in Florida, paternity first must be established. Once this happens in the State of Florida the DOR (Department of Revenue) will likely be the ones who will file amotion for child supportand to establish paternity. A DNA test can be one way to do so. If you know you are the biological father, you can also voluntarily acknowledge that you are the biological father. Remember, once you sign a VoluntaryAcknowledgement of Paternity in Florida, you are legally bound to the agreement. Both parents sign the agreement and both have 60 days to "recant" after the 60 days has passed. Once this has been signed, it is sent on to Vital Statistics and if a court determines through a DNA test or other decision, it is legally binding. Marriage, Divorce, Disestablishment of Paternity in Florida If you are divorcing and have children, marriage presumes that paternity has already been established in the State of Florida. If you are married then have children, it's presumed that paternity has been established. Also, if you weren't married prior to having your child or children, then marry, marriage legitimizes the child or children. Things Happen... But sometimes, even after the State considers the child legitimized, there may come a time when a father may begin to challenge whether or not they are actually the biological father of the child or children. In Florida there are cases of men and women having children together, with the man having acknowledged paternity prior to marriage, then, the couple marries but the father begins to wonder if the child or children are biologically his. Sometimes it's during adivorceproceeding or sometimes while still married the father wishes to seek an attorney and the court's help to disestablish paternity. These cases can be extremely challenging and courts often do deny disestablishment of paternity. How can this happen? It can happen and does. Even if you prove through DNA that you are not the biological father, the courts can determine that you are the legal father and you could end up paying child support until the child is 18 years old. Disestablishment of Paternity Disestablishment of paternity requires most litigants to hire a skilled family law attorney. Should Unmarried Father's to Be Sign the Birth Certificate in Florida? Having a child can be a very exciting time. When a women tells a man he's the father in many cases emotions can overtake common sense. Remember, once you sign a birth certificate and 60 days has passed, you have legally acknowledged being the biological father. Once you do this however, it can be difficult to recant your acknowledgement. If you have any doubts, before signing or acknowledgement, you should seek out DNA testing and call a family law attorney to seek advice. Being a biological father of a child not only comes with financial responsibilities that you will be legally required to abide by.
