Boat and Yacht Rules and Regulations for Chartered Yacht Vacations

The maritime industry has its own set of rules and regulations that must be followed. When in United States waters these laws are set forth by the United States Coast Guard and the Department of Homeland Security.   The regulations are not the same for every type of boat. For example those operating pleasure crafts face less regulation than luxury yacht captains. Typically, there are outlined rules and regulations in the following categories: Licensing Pleasure craft regulations Inland regulations Crew qualifications Licensing for onboard electronics Marine pollution Fishing gear entanglements Securing a boat Security Flag etiquette Boat Registration Weapons on board Storing gasoline/diesel   The Most Common Charter Vessel Errors   According to the United States Coast Guard, the following are themost common vessel violationson chartered yacht vacations:   Carrying over the passenger limit without an inspection: The boat charter cannot carry more than 12 passengers without a Certificate of Inspection, which is issued by the United States Coast Guard. Limiting the hiring/firing power of the captain: The boat charter contract should not limit the captain’s ability to hire or hire crew as needed (the contract should not name the captain and crew). Failing to leave the owner of the boat at home during a charter: The owner of the vessel cannot be on board during a charter or be part of the crew or the master. Accepting visitors over capacity when the boat is moored: There cannot be more than 12 passengers when the vessel is moored (essentially there can never be more than 12 people on the boat either when it is moored or in transit). Defining more than one charterer: Only one person is considered the charterer; the rest would be defined as passengers. Accepting compensation aboard foreign vessels: Foreign vessels cannot carry passengers for compensation and, therefore, must operate as a recreational vessel.   The Notion of Common Sense   In many situations on the water a little common sense will go a long way. Especially as a professional, you have a basic understanding of what looks right and what feels wrong. The internet is at our fingertips (yes, even at sea) and finding the answers to any questions that arise during a trip is only a Google search away.
