Car Accident Laws in the Sunshine State

Car accident lawsvary from state to state, so if you've recently been in a car accident in the state of Florida, you'll want to be sure you are up to date on the unique laws that apply to the Sunshine State. Whether or not you are at fault for the accident, having a full understanding of the state's car accident laws can ensure you are fully protected in the event of a collision. Here are some of the most important laws to consider if you have recently been in a Florida car accident. Comparative Fault Rules A comparative fault rule examines who is at fault for the collision. In Florida, thecomparative fault ruleis considered to be "pure." This takes into consideration the two members of the accident and which party is responsible for which components of the accident. The percentage that you are at fault and the percentage that the other individual at fault is then considered in the amount of compensation you are given in court. This means that if you are half atfault for the accident, you will receive half the money to cover the damages that you were not at fault for. So unless the other individual is completely at fault for the accident, you are unlikely to receive full coverage for your damages. But it also means that even if you are mostly to blame for the accident, you can still receive a bit of money to cover part of your damages. A "pure" comparative fault rule differs from the modified comparative fault rule that many other states adopt. Under a modified rule, you do not receive any monetary support if you are believed to be more than half responsible for the accident. No-Fault Florida also uses a no-fault car insurance state. This means that if you are involved in a car accident in the state of Florida, you will need to use your own car insurance to cover your injuries or damages from the accident. In states that do not recognizeno-fault car insurance, you would be able to file a claim with the other individual's insurance if they are at fault for the accident. You would then use their coverage to pay for injuries or damages sustained from the accident. If the accident has caused permanent injuries, then you are able to step outside your own insurance to make a claim with the other individual's car insurance. The injuries will need to cause permanent disfiguration or cause you to lose a vital function or use of limbs. This also requires that all Florida drivers havewhat is called personal injury protection, also known as PIP. These PIP coverage benefits will be used in the event there is a medical expense or injury related expense after an accident. This coverage can also be used to pay things like lost wages if the injured individual is unable to return to work after the accident. Also Read:Questions about PIP After an Accident in Florida Statute of Limitations Although you won't be able to file a lawsuit for just anycar accident, if a serious injury has resulted from the collision, you have four years from the day of the accident to file a lawsuit. The statute of limitations is so long as some injuries take time to develop and show that they are serious and will have long term affects. In order to file any lawsuit after a car accident, you will need to meet the requirements of a claim. If you fail to file a lawsuit in the time allotted during the statute of limitations, you unfortunately will be unable to make a claim regardless of the circumstances. Car Insurance Requirements Florida also has a set amount of coverage each Florida driver needs to have. This includes things like your PIP benefits, but also includes requirements for property damage liability. Drivers in the state of Florida need to have at least $10,000 of coverage for bothpersonal injury protectionand property damage liability benefits. Because Florida is a no-fault state, it does not require its drivers to have bodily injury liability benefits that would be used in the event that a member of the other car is injured in the accident. If a member of the other party is injured, they will need to use their own insurance to cover the bodily injury damages, unless those damages are serious enough to be considered life-altering and severe. It is also important to note that the state of Florida does not require drivers to have insurance requirements for uninsured or underinsured motorists.
