Criminal and Administrative DUI Penalties

When you are suspected of drinking and driving, there will be a number of factors to consider and defense should begin immediately. One avenue that this can begin in is to not give officers what they want. They will likely try to get you to say something that can be used against you at a later time so it is often best to exercise your right to remain silent. These charges can be dependent on a number of factors including if you have a past record of drinking and driving, if any property damage or personal injuries occurred, if you were found speeding, if your blood alcohol content (BAC) level is found to be extremely high and other related circumstances. There are many penalties that can come and these may be criminal, as well as administrative. Criminal penalties will include those such as jail time, expensive fines and community service.  A first offense can result in up to a year in jail, $1000 in fines and 96 hours of public service. A second offense can lead to a maximum of a year in jail, $1,500 in fines and 120 hours of public service. There will be other costs on top of this such as the court fees. Administrative penalties can also be endured and these are handed by the Colorado Department of Revenue. They include repercussions such as the suspension or revocation of a driver’s license. Dealing with the criminal side of a case will be in the hands of the court while the Department of Revenue will deal with matters such as regaining the right to drive or gaining temporary driving privileges. Taylor Swift Blamed for DUI by Crocs Founder

There are many reasons that can be behind why a person is accused of drinking and driving. Since the initial arrest is left up to the discretion of the officer, any error on their part can put an innocent person at odds with the law. They may administer a field sobriety test incorrectly or not be properly trained on how to use a breathalyzer. There are possible ways to defend against these allegations, such as demonstrating the error that occurred or the lack of sufficient evidence. One suspect recently charged with a DUI has a different reason for why the charges against them were invalid. George Brian Boedecker Jr., the founder of the popular brand Crocs Inc. was arrested after a witness gave the tip to police that she had seen the 51 year old fall unconscious in his Porsche while it was still running. When officers responded the suspect was unstable, slurring his speech and reportedly smelled like alcohol. He then proceeded to blame singer/songwriterTaylor Swiftas the one who had been driving his car. When the officers questioned where Swift was, Boedecker pointed towards a nearby backyard and said she was in Nashville. A conviction for drinking and driving in the state of Colorado can lead to high charges for those accused. Those found guilty can deal with jail time, probation, fines, license suspension, educational programs and other repercussions the court may choose to implement.
