This week on The Broke and the Beautiful, Teresa Giudice will serve time in the prison that was the setting for “Orange Is the New Black,” and the Backstreet Boys settled with former boy-band mogul Lou Pearlman. Also, Girls Gone Wild made a settlement with the Hottest Girl in America 2010.She’s no Piper Kerman, but Teresa Giudice has a tie to the author whose memoir inspired the Netflix hit “Orange Is the New Black.” The Associated Press reported that a judge ruled the “Real Housewives of New Jersey” star would be serving her 15 months at the Danbury Federal Correctional Institution in Connecticut, which is where Ms. Kerman, as well as Martha Stewart, did her time. U.S. District Court Judge Esther Salas denied Ms. Giudice’s request to serve out her time in a halfway house. Ms. Giudice, who was sentenced for multiple counts of fraud, including bankruptcy fraud, will be serving her time separately from husband Joe so that one parent can be home with the couple’s four daughters. After Mr. Giudice serves his time, he could be deported. He moved to the U.S. from Italy when he was 2 and never became an American citizen. (And speaking of New Jersey housewives, former “RHONJ” cast member Danielle Staub got some good news this week in her bankruptcy case—according to Radar Online, a judge in her now-closed bankruptcy case discharged $700,000 in liens against her.) New Bankruptcy Fees Coming Dec. 1 By Jacqueline Palank

Lawyers, pay attention—correcting a mistake in bankruptcy papers is going to cost you pretty soon. Starting Dec. 1, bankruptcy courts will charge $25 to file a motion seeking to redact information from previously filed papers. That means if you forget to slap a black bar over text you don’t want seen by the general public, you’ll have to pay to correct the mistake. One other new fee will take effect next month, according to the Administrative Office of the U.S. Courts. The existing $157 fee to appeal a bankruptcy court ruling directly to a U.S. Court of Appeals, bypassing the district court, will increase by $50 to $207. This isn’t the first time bankruptcy has become more expensive this year. On June 1, fee increases took effect for every chapter of the bankruptcy code as well as for filing lawsuits in bankruptcy court. Rather than paying a $46 administrative fee regardless of chapter, the change imposed a $550 fee on filings under Chapter 9, Chapter 11 and Chapter 15, the cases filed by bigger-pocket debtors like municipalities and companies in the U.S. and abroad. Crucial Bankruptcy Information There are bankruptcy alternatives. Don't think that a difficult financial picture automatically leads to bankruptcy. There are consumer counseling services available that will analyze all your financial information to see if alternatives such as stricter budgeting, a debt consolidation loan utilizing the equity in your home or a debt reduction plan makes better sense for you. You must choose a bankruptcy chapter. Virtually all individual filers choose either Chapter 7 or Chapter 13 bankruptcy. The two filings offer different protections and have some distinct differences. It's a good idea to lay out all your personal and financial information to an expert. A lawyer will use this bankruptcy information to choose one of the two chapters. Chapter 7 is a straight liquidation of assets and debts. There is an income qualification, based on the median income in your state or the absence of any significant disposable money to pay out to creditors. Virtually all unsecured debts are liquidated and a debtor can receive a discharge in as little as 4 to 5 months. Chapter 13 is often favored by debtors who earn higher salaries and can't qualify for Chapter 7, or who have property that could be seized by the bankruptcy trustee and sold and divided up among all creditors. Chapter 13 involves a repayment plan, usually 5 years, that allows debtors to protect virtually all property by including back due payments in the 5-year bankruptcy plan. For example, a debtor can avoid foreclosure by proposing payments over 5 years that will eventually take care of any back due amounts, which also remaining current on current mortgage obligations. The flexibility to retain property not protected by exemptions does not exist in Chapter 7. There is some flexibility with bankruptcy filing fees. Filing a Chapter 7 case will cost $299, while a Chapter 13 case will cost $274. It's possible to get the fees waived in Chapter 7 by showing the court your financial information that shows you are no more than 150 percent above the poverty level in your state. The filing fee cannot be waived in a Chapter 13 case, but it can be included into the repayment plan so that it is more affordable over a 5-year-period. Bankruptcy information will affect your credit score. In fact, bankruptcy is the most significant negative mark on a personal credit report and remains on the report for up to 10 years. However, this shouldn't scare you from filing for bankruptcy. If your financial situation is serious enough to consider bankruptcy, it's likely that you have already been late or payments or had other issues that have affected your credit score. Many creditors report their bankruptcy information not standing in the way of credit cards or car loans for long, with home loans available as soon as a year or two, though generally at higher rates. ...read more
