It's been awhile since I touched on this subject back in June 2007. I just recently closed on a home for my buyers after a long and exhausting search for a home that we didn't have to compete against overzealous buyers pushing up the price. Don't get me wrong here. If there are other properties in the area that are in the same price range, that's fine. But when you unwittingly go and continue to try and throw money at a deal just to win the war, you've lost. Why? Because if you are not prepared or willing to pay over and beyond what the property will APPRAISE for, you will not get a loan on that property and your deal will definately fall through! I had two agents come back to me asking if my client was still interested in their property. I told them, "Too late. We are moving over the weekend on another home and will close by Christmas". By the way, the home that was purchased was a bank owned Fannie Mae property. The National Federal Mortgage Co. has been doing an excellent and swift job in closing the deal on these properties. We closed within 40 days! Short sales are still a mystery to alot of real estate agents as well as to alot of loss mitigation agents and asset managers. So stick to your guns and don't let the misinformed drag you into a lot of grief and time wasted. Keep your emotions in check and you should find the home that you are looking for at the right price. My Homeowner Recovery Plan

To the distressed homeowner; punt. Come to grips with your situation. You got into an overheated market that was fueled by greed and the availability of 'cheap, easy money'. Or you had to use your home as an ATM machine. I know that you meant to pay it back, so did I. I wish that I knew more in 1995 than I know now. My plan of 'resolve' is straight forward, legal, and will allow you to live again without the fear and uncertainty that you and your family are facing now. I know that this may not set well with many of you, but it is a solution. A solution that will spare you the anxiety of foreclosure and being thrown into the streets. What about the 'homeowner rescue plan'? Unless that you can show an ability to repay, have stable employment, and have "EQUITY" you will not qualify for the loan modification. Here's the outline of my Recovery Plan; 1.)  Come to grips with your situation and cut your loses through a short sale. Check with an attorney or CPA to realize any tax implications. At this point you don't want to go bankrupt or lose your home to foreclosure by walking away. The Plan won't work if you go through any of these situations. 2.)  Repair your credit through a credit counseling agency. This will be required with most short sale transactions. 3.) You will be renting for three (3) years and you will need decent credit to apply for acceptable housing. 4.)  After you have not owned any real estate in the past three (3) years, you are now eligible to buy a home again as a first time homebuyer!  Immediate benefits of this plan are; 1.)  The fear, stress, and uncertainty are gone. 2.)  Potential liability from lawsuits brought on by the lender are gone. 3.)  You get a chance to start over and rebuild your credit. Long term benefits include, entering a housing market that makes sense, a predictable 30 year fixed mortgage with a low interest rate and low 3% down payment, lower property taxes, regaining tax benefits, and regaining your pride of homeownership. It seems drastic and unthinkable. But this Plan is working for many in Southern California as many are able to buy again in their former neighborhoods. Would I have taken this deal in 1994? In a heartbeat, now seeing what has happened to my credit and life over the past 13 years. You don't have to go through this ordeal. It's your choice.
