Exceptions to Implied Consent Law

The requirement that all motorists provide a chemical specimen pursuant to an implied consent statute usually applies to scientifically recognized tests (blood, breath and urine). Most states do not require motorists to submit to a PBT, which is often administered at the scene of a drunk driving test. Although chemical testing is mandatory, there are exceptions to this general rule of law. The implied consent statute obligates every motorist to provide a chemical specimen to measure their BAC level. The most common exception to the statutory requirement involves the police officer’s legal obligation to inform each motorist of their rights. Most statutes require officers to advise defendants of their legal rights and the ramifications of taking or refusing a chemical test. An inadequate advisory is grounds to suppress evidence to a chemical test refusal, provided it would have been admissible in court. The suppression of evidence can occur if the officer misleads the defendant about their rights, distorts the consequences of a chemical test refusal, or coerces them into compliance with threats or promises. The officer’s exact words are crucial, so listen carefully to the terms used e.g., may versus shall, or could versus would. In the State of California a Private Investigator is how a licensee is referred to by the Business and Professions Code.  KROLLPFEIFFER&Co.; is a licensed Private Investigations firm.
