Canada Immigration DUI No Longer Welcome In Our Borders

If you are planning o  a trip up to Canada, you may want to have all of your criminal convictions laid out on the table. Many tourists are getting a surprise when they find out they are unable to enter the border due to a past conviction, even if it is from years ago. There are families and students getting turned away daily from study, work, and sightseeing due to a heightened awareness at Canada's border patrol. If you have a conviction you simply may not be allowed to enter the country. Recently more tourists are going to their search engine of choice and typing in "can i enter Canada with a DUI" as a means of finding out what the policy is. This article is designed to help you understand some of your options.   One of the most common convictions that is keeping citizens even from the United States out of Canada are DUI (driving under the influence) convictions. One of the largest problems with this policy is so many travelers no nothing of this initiative before they are at the border. You can only imagine making the trip up to Canada to visit Quebec or Montreal only to be denied. It would definitely but a barrier to most travelers plans and ruin a very good vacation. If you have any type of conviction in your past you will want to address it as soon as possible before you plan on leaving. The following information is going to help you decide if you are admissible into Canada's borders with a past DUI conviction. Why Is A DUI Inadmissible Into Canada? Unfortunately driving under the influence is a rather common offense among people. Just in the United States alone there are over 1.4 million arrests each year. In fact, it seems a new celebrity is getting arrested for a DUI on a weekly basis. A drunk driving charge can appear on your record in a number of ways. Some of the most common causes are: Driving While Impaired Driving Under the Influence Driving While Intoxicated   The heart and soul of Canad's border patrol is to protect her citizens and this is done by denying any individual who may cause harm either through a major or minor offense. It is best to do as much research on your own to determine if your charge is going to deny you entry into the country. What Are Your Available Options? If you do have a criminal record or DUI, you do have some options available to you to enter into the country. There are several factors involved that will help you choose the best option for your situation. The number and type of offense in your past, when sentencing was completed, and the severity of the offense all will come into play. For offenses that have been committed outside of Canadian soil will be judged based on an offense equal to that in the Canadian criminal justice system. While your offense may have been deemed minor in the United States, the Canadian border patrol may think differently. There are several paths a Canada immigration DUI authority can choose for an individual who has a past DUI conviction. One of the most common procedures is for the individual to be offered a TRP, which allows entry into Canada on a temporary basis. The permit can be issued for an amount of stay, up to three years. The TRP is your best course of action if you most recent offense was five years or less. The amount of time it takes for your TRP to be processed will vary by various Canadian visa offices. If you plan to apply for a TRP, it is best to begin that pursuit at least 6 months to a year prior to visiting Canada. The nest way of receiving a TRP is at the Canadian border. This was introduced in 2012, as a means to help individuals who needed to enter Canada. However, these permits are designed for emergency purposes and not handed over easily. It is actually best to speak with your attorney before you apply for a TRP at the border. They will be able to tell you if that is your best course of action. If you are looking for a permanent solution to your inadmissibility issue you can apply for what is known as "Criminal Rehabilitation". To be eligible for this program, the offense must have occurred more than 5 years ago. Once again this can be a rather lengthy process, taking up to a year or more for completion. It is best to begin as soon as possible if you plan of visiting Canada. You will also be able to apply for the TRP while you have a criminal rehabilitation application processing. If you happen to only have one DUI conviction on your record and it happened over ten years ago, you may be deemed rehabilitated simply due to the amount of time that has passed. Keep in mind though that it is up to the officials on the difference between inadmissibility and rehabilitated. Just because you believe you have been rehabilitated does not necessarily grant you admission into the country. You will need to carry legal proof stating why and how you are eligible to enter the country. Advice For Applying - Canada Immigration DUI Obviously Canada takes the security of her residents very seriously. There are many day tourists who are getting turned away at the border because of a forgotten conviction. Just because you have a conviction, does not mean you will never be able to enter the country again. There is a system in place it just may take some time. If you have something in your past that you may think might limit your ability to enter into Canada, it is best to talk with your lawyer. In fact, it is a good idea to go through your history and try to think of anything that might have happened somewhere in the past that might come back and bite you at the border. It is best to be proactive in this matter and get everything out in the open before you try to get into the border.
