What are the Risks for Owner-Builders?

What is an Owner-Builder?  First let's define exactly what is an Owner-Builder is, according to the an owner-builder is what the term indicates: a person who owns the  and acts as their own general contractor on the job, and either does the work themselves or has employees (or subcontractors) working on the project.  The work site must be their  place of residence that they have occupied for 12 months prior to completion of the work.  The homeowner cannot construct and then sell more than two structures during any three-year period.  Any individual or group of individuals who own property on which they plan to construct, alter repair, improve or remodel a building or structure is considered an owner-builder.  Also, a  may be considered an owner-builder (on a case by case ). The Limitations An owner-builder is not required to have a contractors license.  However, there are still some limits.  If he or she does the work themselves or through their own employees with wages as their only compensation, and the structure is not intended for sale, then a license is not required.  The owner-builder must  with licensed subcontractors. This license exemption limits the number of structures offered for sale on the construction of single-family residential structures to less than four within one calendar year.  If the owner-builder hires a General Building ("B") contractor than the number of structures is unlimited.   If the following exists, a homeowner imporving his or her place of residence is exempt from licensure: The homeowner has not taken advantage of license exemption on more than two structures during any three-year project.  The homeowner has resided in the residence for 12 months or longer prior to the completion of the work.  The construction work is performed prior to the sale of the property. There is one trade that property owners are prohibited from performing themselves and that is well-drilling work, which is covered under the Well Drilling (C-57) . The owner-builder license exemption applies to any individual who builds homes for resale under the following : Only licensed contractor tradesmen are hired to perform all project work (as long as no more than four structures each calendar year are intended for resale.  A General Conractor who is properly licensed is hired to perform the work or subcontracts the completion of all the work on the project.  In this case there is no  on the number of structures completed each calendar year. The owner-builder performs the work and resides in the completed structure for one year prior to resale and applies the license exemption to not more than two structures in a three-year period. The Risks Making mistakes on a construction job can be costly and take extra time to correct and repair unless you are knowledgeable about construction.  An owner-builder should be educated about mechanics  and how to prevent them.  Suppliers and sub-contractors who are not paid on time may file mechanics liens against your property.  If your workers are injured, or any sub-contractors are not licensed or do not carry workers compensation insurance or liability insurance, and they are injured, you could be required to pay for their injuries or  through your homeowners insurance or be faced with serious lawsuits.   It's important to be cautious of individuals who prey upon unsuspecting homeowners claiming to be contractors but who are actually unlicensed.  They may make false promises offering to help you with the owner-builder process for some kind of consulting or supervisory , but in doing so they are breaking the law. Is an unlicensed contractor breaking the law to advertise services?

Is an unlicensed contractor breaking the law to advertise construction services?  That's a good question and one that gets asked a lot around here at Academy License Center (ALC).  The answer to that question is no.  As long as the advertisement states that the contractor does not have a contractor's license. However, licensed contractors are required by law to always include their contractor license number any time and anywhere they advertise their services.  Remember, the requires any individual or business doing a construction job that's $500 or more including (labor and materials) must have a contractor's license.   All businesses or individuals who construct or alter any building, highway, road, parking facility, railroad, excavation, or other structure in California must be licensed by the California Contractor State License Board (CSLB) if the total cost (labor and materials) of one or more  on the project is $500 or more.  Contractors including subcontractors, specialty contractors, and persons engaged in the business of  must be licensed before submitting bids.  Licenses may be issued to individuals, () and . – CSLB All too often unlicensed contractors bid on projects well over $500 and run the risk of being cited by the CSLB for bidding on jobs illegally. The citation  can be quite costly running thousands of dollars, including jail time.  The CSLB routinely sets up  operations throughout California in order to catch unlicensed contractors in the act of submitting bids illegally. Please don’t let this happen to you. Don’t jeopardize all of your potential for what amounts to pennies investing in your future.  It’s a small price to pay for peace of mind.  Being a licensed contractor does not make you a better contractor than you already are, but it does make you legal, and there’s no doubt that customers  not hesitate to choose you because you are more professional.  In that regard having a  California State Contractors License makes all the difference in the world – in your business and especially in your personal future. “The one who fears to act is always struggling with misfortune” – Franklin D. Summer - A Great Time for a Contractor's License!  Summer is a great time to get your contractor's license.  If you’re wondering why… let me explain.  To begin with the  usually doesn’t get as many contractor license applications during this time of year largely due to the fact that many contractors are taking advantage of the good weather and working hard to complete construction projects.  That means if your one of the lucky applicant’s applying for your contractor license in the good old summer time… your chances of getting a quicker test date are much better. However that  quickly change as we approach the fall season.  What’s on everyone’s mind as we enter the fall is “Back to School” time.  Naturally a lot of contractors start thinking about getting their contractor's license before the end of the year arrives.  Another great reason to apply for your contractor’s license in the summer is so you don't miss out on the great opportunities for work. There are so many construction projects that go on during the summer. Especially while the weather is good and there's no rain to worry about.  With your contractor's license in hand you can go after the bigger projects or take on those construction jobs on the side that you have wanted to do, but perhaps put off because you didn't have your contractor's license.  If you need a final reason... all of our contractor courses here at Academy License Center (ALC) are currently available at  prices for all contractor trades.   Recently I heard from one of our students that he got his contractor license test date  2 weeks from the time he mailed it in! This is pretty shocking news when you consider the usual time frame is approx. 6-8 weeks.  He said he sent it in on August 10th and got a notice in the mail on August 23rd.  His test date is set for September 4th.  This further validates that applying for a contractor’s license in the summer, can increase your chances for a quick test date. Could this be a new trend for the CSLB or did he just get lucky?  We'd like to hope the CSLB is getting quicker processing applications for a faster test date. However, it's possible our student friend just got lucky... the CSLB may have had another applicant request to change his test date so an open spot became available.  Contractor applicant's can request to change their test date for another time if they pay a re-test  of $60.  We'll keep our eyes and ears open for any more news on contractor license application processing time.  Keep checking in and we'll keep you posted.
