Process of Getting a Divorce in Arizona
Divorce Process in Arizona Facing a divorce can be a very scary proposition for most people. That fear is made worse when you do not know what to expect or the steps needed to complete your divorce. One of the best things you can do is to learn everything you can about theprocess of divorceas soon as possible. Once you understand the steps needed to complete a divorce, you will have relieved a lot of stress and pressure and can focus on completing your divorce. A divorce starts in Arizona with one of the spouse's filing a Petition for Dissolution of Marriage in the County Court in which either that parent lives or the other parents lives. That Petition and some related documents are then served on the other spouse by a private process server. The person served with the divorce petition then must file a Response to Petition for Dissolution of Marriage to avoid being defaulted. If the person does not file a response, the filing party may file a Petition and Affidavit for the entry of a default. If a default is entered, the court may enter a divorce decree to end the marriage. If a response is filed, the court will provide both spouses time to exchange financial information and documentation to prepare both spouse's to present their case at a final divorce trial. Prior to a divorce trial, the court may schedule a mediation in an attempt to assist the parties in settling their disputes. Prior to mediation, the court will typically schedule a Resolution Management Conference to determine what is preventing the parties for settling their case and to ensure both spouses have exchanged all of the information and documentation they need to be prepared for a divorce trial. During this process, either party may file a Motion for Temporary Orders. A Temporary Orders hearing is scheduled to decide issues such as custody of the minor child, child support, spousal maintenance, payment of community bills and even attorney fees. If the parties have not resolved their disagreements in mediation, the case will proceed to trial. The court will provide both parties with time to present evidence at that trial. The court will then issue a final divorce decree resolving all of the unresolved issues.
