I am writing to inform you of a Real Estate scam that is taking advantage of and ruining the American Dream of owning a home. Arizona Revised Statues § 33-411.01 states “Any document evidencing the sale, or other transfer of real estate or any legal or equitable interest therein, excluding leases, shall be recorded by the transferor in the county in which the property is located and within sixty days of the transfer”. The Seller, Craco Properties LLC and Canyon State Servicing, where we make our payments have not filed the Warranty Deed, causing us to be unable to refinance our house and we will ultimately lose it in October of 2014 due to a clause in the "mortgage". Let me explain further: We left Pennsylvania over three years ago when our twins were only 4 months old. Looking to provide a better life for them, we chose Arizona. Having both been in previous marriages, my husband and I did not have great credit. I had to go through bankruptcy to remove my ex-husbands debts. I did however cash in my Pennsylvania Educator Retirement and had a nice down payment, even after the penalty. We went through a Real-Estate agency, found our dream home and thought we purchased it. We have paid our taxes, HOA, repairs and “mortgage” payments. Understanding of our credit, we wanted our children to grow up in the same home their whole life, we understood the clause in our loan that states if we do not acquire refinancing by October 2014 we had to return the house to the seller. In three years, we brought our credit scores up significantly and obtained loan approval from Loan Depot. We were prepared to close on the refinance on August 30, 2014 when two days before, we were notified that the Warranty Deed had not been filed and Loan Depot would not refinance unless it was filed. The Warranty Deed is currently being held hostage by the out-of-state seller and the servicing company. They will not release the Warranty Deed unless they have funds in hand, but Federal guidelines state that there is a three day holding period and this cannot be waived. I stand to lose my house in October due to this scam. My attorney is currently addressing this, but due to the time lines, I'm not sure what will happen unless there is a better attitude from Craco Properties LLC and Canyon State Servicing. ...read more
