IS ARBITRATION AN OPTION FOR SOCIAL SECURITY DISABILITY CASES?

In the strict sense of the word, arbitration is not available in Social Security disability denials.  However, a process that is very similar to arbitration in many ways can be used.  Your representative can present a legal memo which outlines the strong points of your medical evidence.  He or she may file a petition for a fully favorable decision based on the strength of the medical evidence and other factors in your particular case.  If the administrative law judge who is reviewing your case agrees, a favorable decision could be issued and your payments started.  Also, you wold receive any back pay or past due settlement to which you are legally entitled. If this is not possible, the case would go to hearing, which also uses some of the same principles of arbitration: 1.  The evidence will be heard by an impartial third party called an Administrative Law Judge. 2.  Both the claimant and his representative may be present for the hearing. 3.  The Government will not have a lawyer present to argue against you at the hearing. 4.  The hearing is non-adversarial and semi-formal in nature. 5.  A new decision will be issued within 90 days of the hearing. The process and procedure for Social Security disability claims and appeals are governed by the 20 Code of Federal Regulations, Parts 400 - 499 and by the Social Security Act, as amended.  Federal court decisions may also set forth legal stipulations that must be applied.  Having a representative that is familiar with the various regulations and rules will give you the best chance of winning your claim or appeal.  You will not be charged a fee (or expense) for representation unless you win your case and collect past due benefits.
