New Laws Affecting Medical Malpractice Cases in Massachusetts

During this six month period, both sides will have a chance to negotiate a malpractice settlement so that a lawsuit does not have to be filed. Interestingly enough, Massachusetts is seen as the “model state” for Obama’s health care law as it became the first state in the nation that requires every resident to obtain health insurance. The new law is expected to save the state approximately $200 billion in health care costs over the next 15 years, and is actually the second step this year that Massachusetts has made to control medical malpractice costs. Back in April, seven hospitals throughout the state announced a “Road Map to Reform” plan that was focused on preserving patient rights and ensuring the fair compensation of injured patients. The doctors and nurses at these seven hospitals will start fully disclosing medical mistakes to the hospital and to their patients. The hospital will then investigate the root cause of the injury to determine if the caregiver, hospital policy or medical systems were to blame. If it is found that the caregiver is at fault, they will apologize and the hospital will work with medical malpractice insurers to determine a fair compensation amount. One of the ways that the new Disclosure Apology and Offer law is expected to reduce costs is by avoiding the costs ofmedical malpracticelitigation, and the goal of this law is to settle an amount of compensation by negotiating with the patient.
