How Does Time Tracking Fight Exploitation Of Workforce

Labor laws are slowly changing in the EU, and it seems they finally are focusing more on protecting the employees from wage and time theft. It all started two months ago when the European Court of Justice (ECJ) declared all companies will be required to time track employees’ working hours. What Happened? Spanish trade union, the Comisiones Obreras (CCOO) filed a lawsuit against Deutsche Bank. The reason was to enforce the bank to record overtime worked, which the bank rejected, arguing that the Spanish law doesn’t require employers to set up an employee time tracking system. However, European Court of Justice (ECJ) decided this doesn’t comply with the Working Time Directive, which specifies the maximum number of working hours and mandatory rest workers are entitled to. The ECJ declared that “In order to ensure the effectiveness of the rights provided for in the Working Time Directive and the Charter, the Member States must require employers to set up an objective, reliable and accessible system enabling the duration of time worked each day by each worker to be measured. “ What Does It Mean? ECJ stated that “It is for the Member States to define the specific arrangements for implementing such a system, in particular the form that it must take, having regard, as necessary, to the particular characteristics of each sector of activity concerned, or the specific characteristics of certain undertakings concerning, inter alia, their size.” The ruling doesn’t provide special guidance on how employers should measure working hours. It’s up to EU member states to closely define the methods for employee time tracking. How Does It Protect Employees Rights? First of all – time tracking creates an objective proof against unpaid overtime. It’s not unusual for employees to not get paid for working after hours, which happens more often in certain branches. It goes without saying that many workers aren’t complaining about unpaid hours, simply from fear of being easily replaced. According to TUC analysis, UK employees did more than £32 billion worth of unpaid overtime in 2018. For teachers, this averaged around 12 hours of unpaid time each week! This ruling is a first step towards achieving more equality in work space. A time tracker measures how much time employees spend on their tasks, and how many breaks they take and for how long. The Working Time Directive requires workers to take a 20 minute break after a 6 hour work period, which can be delayed or interrupted for specific reasons like an emergency case, but it has to be compensated right after. There is no excuse for workers to skip their lunch breaks to get more work done in fear of staying late. Taking breaks during work affects the quality of work. There is a proven connection between increase in work time and decrease in productivity. Working overtime creates stress and wears a worker down, making it easier for him to lose focus and make a mistake.. And that is bad for both the employee and the employer. By taking breaks after hours of consistent work, employee can relax and refresh before continuing with their daily tasks. Time tracking report gives employees a valuable insight into their work routine. It shows when they are most efficient, and when distractions begin. Since 9-5 office hours are a history in many business branches, it’s helpful to know the productivity peak hours and plan work around them. Ways Of Time Tracking The traditional method of time tracking was using spreadsheets. Writing start and end work times and lunch breaks by hand has obvious flaws, the main one being you need to assign someone to take those notesOn the other hand, if it’s done by every worker individually, it can become an unusable mess. And it’s still time consuming. With technology improvements and office digitalization, paper spreadsheets were soon replaced by punch cards – employee IDs. Each worker has their personal card that is scanned when entering and leaving company building, so working hours are tracked electronically. However, there’s no way of tracking breaks taken in the office. The advanced method of time tracking tool is a specifically designed employee tracking software. There’s a long list of time tracking software on the market, and they range from simple clock in and out time trackers to detailed work reports. While it’s supposed to protect employee’s rights, the lack of specific information leaves enough room for abuse. Implementation of employee time tracking tools that, like Workpuls, track all actions done on computer, means an employee’s personal information is visible to the employer. In order to feel their privacy rights are protected while their computer is being tracked, it’s important to create a privacy policy with a consent form.
