I’m not exatly what you’d call a review person. In fact this could easily be the first ever detailed review that I’m posting online. A few weeks ago, I ended up misplacing my key bunch. No matter how much I racked my brains, I couldn’t figure out where it’d gone. I strongly suspected that someone had stolen it and being as paranoid asI was, I dropped by a hardware shop for advice. The guy over there told me I needed to get all my locks replaced and was trying to convince me into buying a whole bunch of locks. Business Income Tax in New Jersey

For New Jersey businesses, dealing with taxes in a high-tax state is a major consideration for business operations. This is why businesses operating in New Jersey need to be familiar with the state’s methods of taxing business income -- particularly when attempting toavoid potential penalties and fines. As with most states, New Jersey taxes businesses by two primary methods: (1) corporations are subject to a state corporate tax, and (2) income from pass-through entities is subject to the state’s personal income tax. The basics of each of these methods are examined below. New Jersey Corporation Business Tax Traditional C corporations operating in New Jersey are subject to New Jersey’s corporation business tax (CBT). The CBT rate is generally based on the business’s entire net income, with three corporate tax rates as follows: 6.5% on net income of $50,000 or less 7.5% on net income of $100,000 or less, over $50,000 9% on net income over $100,000 For New Jersey C corporations, the state corporate tax owed will generally be the greater of the following: The applicable tax rate above based on entire net income An alternative minimum assessment (AMA) based on gross receipts An AMA based on gross profits Most New Jersey S corporations are taxed as pass-through entities, which are discussed below. However, the New Jersey CBT does apply to S corporations that are subject to federal taxation. These S corporations pay a graduated tax based on gross receipts. One advantage of New Jersey tax law for businesses is the state’s lack of a franchise tax or privilege tax. Many other states impose this type of separate tax on businesses. The basis for these taxes is that the businesses are being taxed for the privilege of doing business in the state.          Taxation of Pass-through Entities in New Jersey Under New Jersey tax law, non-corporate businesses are generally taxed as pass-through entities. These businesses are not subject to any state or federal tax. Instead, New Jersey taxes the business income “passed through” to the business owners as personal income. The following are the common pass-through entities: S Corporations: Each individual shareholder of an S corporation will be taxed on their share of the corporation’s taxable income. The shareholders will be taxed at New Jersey’s personal income tax rates. However, New Jersey S corporations that owe federal tax will be required to pay New Jersey’s CBT based on gross receipts. Limited Liability Companies: Each individual member of the limited liability company (LLC) pays New Jersey personal income tax on that member’s share of the LLC’s income. The LLC itself does not pay state or federal income taxes. But note that an LLC can elect to be classified as a corporation, in which case it would be subject to New Jersey’s CBT. Partnerships: The individual partners pay state and federal tax on their shares of the partnership income, while the partnership itself pays no income taxes. Sole Proprietorships: The sole proprietor pays federal and state income tax on the business’s income.
