How to Settle With a Workers' Comp Plan

Workmen's compensation claims are filed by employees who suffer from an illness or injury that occurs while on the job. After a workmen's compensation claim is filed it is necessary for the employee and employer to agree on a monetary amount that is fair to both parties in order for the claim to be settled.


  1. Report the accident, illness or injury to the manager or supervisor on duty right away.

  2. Obtain medical treatment if needed as soon as possible.

  3. File a workmen's compensation claim with the human resources department of the company where you work.

  4. Visit the doctor that is assigned to you by the employer on the scheduled date and time to have the illness or injury for which you are filing accessed by a medical professional.

  5. Wait to see if you are approved or denied for workmen's compensation benefits.

  6. Carefully consider the amount of the settlement offer that is offered to you. Once you agree on an offer, you cannot go back later and ask for a higher settlement.

  7. Review the amount of money that you think is fair by comparing the settlement offer you have received against other claims online. The more severe the injury is, the more money you are eligible to receive through a workmen's comp settlement.

  8. Have an attorney look over the settlement offer and give you advice on whether they believe the settlement offer is fair for the injury that has been received.

  9. Determine whether you are going to accept or deny the settlement amount offered.

  10. Appeal the decision if you do not agree on the amount and wait for an administrative board to review the case and come back with a different settlement amount.

  11. Sign the necessary paperwork which shows that you agree to the settlement amount and you will receive a check for the agreed upon amount shortly after.
