How to Begin Medical Litigation for Personal Injury

When it comes to medical litigation concerning a personal injury, you need to know that it takes planning to make sure you are successful. Your claim needs to be valid and within the personal injury parameters as set by the law. In some cases you may want to hire an attorney if you are unsure of the process, but you can represent yourself.

  1. Make
sure you have copies of your medical reports including any police
records of the incident of the injury. Sometimes the injury may not
have needed the police called, so there will be no records, which is
okay. The important aspect of medical litigation is to remember to
have as many copies of the incident as you can as well as all your
medical bills. In addition, if you had witnesses, you should get
their testimony in writing so you can have everything related to
your case. Keep everything neatly in a folder.

  2. Consult
with an attorney or you can check to see what the laws are in your
area regarding medical litigation for personal injuries. If you hire
an attorney, he or she will get part of the settlement, so if you
want to avoid this and feel that your case is fairly easy to win,
you can do the litigation yourself.

  3. Find
the court in your area where you will file the medical litigation
suit if you are handling the case on your own. Depending on the
personal injury case size, you may be able to file it in small
claims court. Larger cases for bigger dollar amounts need to be
filed with a larger court. You can check with your Municipal Court
in your city for the proper court to file your case. You will need
to set a court date and be sure to arrive early.

  4. Present
your evidence, copies, medical bill copies, and your witness list to
the court. The judge may want to hear from your witnesses of the
personal injury, so make sure they are willing to appear in court on
the date you are to see the judge. You may have to negotiate a
settlement and if you are not prepared for this you may end up
getting less than you could have. Therefore, seriously consider
hiring an attorney to handle your medical litigation for personal
injury case especially if it is for a large sum of money.
