Bully and charging fee for use of debit/credit card

The people there didnt seem bad except that the store clerk laughed at my son for coming in and asking for cigarettes in a hateful way. my son is 9 so he is obviously underage and was showing that he was hurt by them laughing at him. We had sent him over with change a...nd told him to pickup some pop but only pop cause mom needs the change for cigarettes and he misunderstood then went and asked for "Menthals" and the store clerk and 3 others laughed at him and he came home crying because of it. I went in and confronted then guy about it and he didnt say he was sorry or anything. Didnt deny it or anything. I then remembered why I dont go in there much and why I will drive 3 miles away from his store for stuff like cigarettes and such and that is because they will charge you a fee to use your debit/credit cards. I was informed that this is not legal and violates the agreement by visa/mastercard. While I was confronting the clerk I asked him and he admitted they charge all credit/debit card users and it doesnt matter the amount. I got it all on video on your tube for all to see. the video is here: htt p://redir.su/5819 and the mastercard/visa info is located with your credit card documentation and clearly states:\t\nFrom MasterCard's merchant rules - Visa has similar wording in their agreement. \t\n5.9.2 Charges to Cardholders\t\nA Merchant must not directly or indirectly require any Cardholder to pay a surcharge or any part of any Merchant discount or any contemporaneous finance charge in connection with a Transaction. A Merchant may provide a discount to its customers for cash payments. A Merchant is permitted to charge a fee (such as a bona fide commission, postage, expedited service or convenience fees, and the like) if the fee is imposed on all like transactions regardless of the form of payment used, or as the Corporation has expressly permitted in writing. For purposes of this Rule: \t\n1. A surcharge is any fee charged in connection with a Transaction that is not charged if another payment method is used. \t\n2. The Merchant discount fee is any fee a Merchant pays to an Acquirer so that the Acquirer will acquire the Transactions of the Merchant. \t\n10A.3 Charges to Cardholders\t\nRule 5.9.2 does not apply in the European Economic Area. \t\nIf a Merchant applies a surcharge for payment by Card, the amount or method of calculation of the surcharge must be clearly indicated to the Cardholder at the POI location and must bear a reasonable relationship to the Merchant's cost of accepting Cards.
