Today, these platforms provide individuals with the capability to negatively impact the reputation of a plaintiff, whether or not there is an intent. Even more, facial recognition and caption functionality can also create challenges for a plaintiff. In turn, such realities could ultimately hurt a plaintiff’s pursuit of justice. Today, when a Facebook user posts information on their account they have the option to have it publically shared. This option opens up the potentiality of details surrounding one’s personal life becoming available to the public. For example, inZimmerman vs. Weis Markets, the plaintiff had sued his employer, Weis Markets, for injuries he suffered on the job. However, once the defendant found photographs of the plaintiff with a black eye before and after the accident in discussion, the plaintiff’s argument was negatively impacted. These photos were publically available on the plaintiff’s Facebook and Myspace accounts. The plaintiff attempted to use privacy arguments to protect itself from this information, however the arguments did not prevail. The court supported this decision by quotingRomano v. Steelcase, noting that refusing the defendant’s discovery request would “condone Plaintiff’s attempt to hide relevant information behind self-regulated privacy settings.” Furthermore, the instant release of material on a social media platform can cause inadvertent consequences. As a case, if a plaintiff is suing the defendant for causing harm endured during an altercation, and the plaintiff shares seemingly inappropriate photos on Facebook from the altercation, the plaintiff’s reputation may be hurt. Likewise, if a third-party Facebook user publically shares a photo of the plaintiff engaging in similar behavior during the altercation, with the plaintiff’s Facebook account identified in the photo, his argument again may be diminished. Moreover, not only could the photo itself cause harm to the plaintiff but the individual who posted the photo could cause reputation damage through the use of captioning. Referencing the aforementioned example, a third-party Facebook user could caption the photo which displays unruly behavior, “Just another typical Saturday – drinking a lot and acting crazy!” Akin to Facebook’s facial recognition technology, no consent is required by those identified in the photo to include a caption. As a result the plaintiff’s reputation can again be compromised. In conclusion, because of an individual’s capability of publically sharing content and opinions through social media platforms, a plaintiff’s reputation may be unintentionally harmed via such technologies. The ability for these platforms to allow users such opportunities as creating public content and recognizing another user in a photo create challenges for a plaintiff’s pursuit of justice.
