How IRS Proves Trust Fund Liability

My Trust protects my assets correct? No!

My Trust protects my assets correct?  No! I hear this every week.  For some reason there is a common misunderstanding that once a person has a Trust that all assets placed in the trust are protected from all creditors, including the IRS, the State, Consumer Creditors, Banks, Judgment, etc.  Nothing is further from the truth!   The Trust only protects your assets upon death.  It allows your assets to go to the designated heirs.  That is it.  Nothing more.  Those having the misconception that their house is protected from a creditor's collection simply because their house is in their a trust will be sadly awaken one day.  If you have a Judgment and have not undertaken any asset protection prior to the Judgment, it is probably too late to do anything but to file a homestead on your property, if you are in a State that allows it.  However, if you have no creditors, who you are in default with, then you can act by:             Placing real property (other than your home) into a LLC             Operating your business as a corporation or LLC             Using Deeds of Trust to secure your home's equity When incorporating an LLC  I often use a Wyoming LLC.  The laws in Wyoming are very protective for the owner and the fees are very economical.
