The common ground among all child custody cases will be within the "elements" of child custody. Those elements involve parents’ income, number of children, children’s needs and physical custody. There are many circumstances to consider and each requires an individual review by legal professionals, state family services and the family law courts. One is based on sole custody when the non-custodial parent will be providing the support payments. The second is joint custody where both parents are reviewed for ability to financially support their children and determine those needs. Non-married adults may express paternity questions necessitating testing to confirm the paternal father prior to establishing custody and payments. In most cases, the mother is awarded sole custody if never married.
